"Some say disciplinary ac tions fall under that (student records) and therefore are protect ed by the amendment." Criminal records are not pro tected by the Buckley Amend ment, so although the University was investigating what could be a criminal act, the incident is pro tected by the amendment because no criminal charges were filed, Tomlinson said. In a Battalion interview on Jan. 28, Corps Commander Matthew Michaels said the two cadets had "fraternized," which is strictly against Corps policy. The accused cadet, a senior band member, was suspended from his leadership position in the Corps, which Michaels said was not an indication he was guilty of the allegations.
