The court was advised, however, that the lawsuit did not include all the issues raised bv educators against the Texas Examination for Current Administrators ami Teachers, or TECAT. The Texas State T eac hers Asso ciation had asked the court to delay the Starr Counts suit and consol idate it with the tSTA suit in which the 3rd Court of Appeals at Austin ruled Friday that the literacy exam administered to all Texas educators was a legal exercise of the state's “po lice power.” I he Supreme (kiurt denied that motion. “Ours is the only case which in cludes aU the issues — both statutory and constitutional — and ours is the only case which represents all ad ministrators and teachers m Texas.” TSTA President Chailes Beard said in a statement. Representatives of TSTA were in die courtroom for oral arguments on the Starr (aiunty case filed by Picrject Principle Inc., a nonprofit teac hers’ organization. The organization obtained a tem- iMirarv restraining order from State District Judge Ricardo (kircia that said the state could not take away the educators’ teaching certificates if they failed the exam Assistant Attorney (>eneral Kevin O'Hanlon said teachers are not be ing “singled out” by the tests, since certified public accountants, lawyers, medical .students and engineers all must pass multipie-part tests to be certified The intentions of the test are “to make teac hmg truly a profession in this state.” he said. “What we’re try ing to do is create a profession, if you w ill ," However, Chief Justice Hill added that (km haps a test on subject matter would lie a “better gauge" of a teach er’s competency.
