The State Board of Education voted 12-2 Saturday to urge lawmak ers to define what kind of private schools and home schools are legal under the state compulsory atten dance law. The resolution, approved in lieu of proposed rules for private and home schools, also includes optional guidelines that can be used by school districts that want help in dealing with those facilities. Ann Nila Taylor of Snyder said after the vote, “The problem with leaving this to individual school dis tricts is there are some districts that say home schooling is illegal, no mat ter what.” But she is pleased that the Legis lature will be the next battleground. “If we can get proper legislation, a statewide amendment or whatever, it will be a good thing,” Taylor said. “I have no objection to f iling with my local superintendent and telling him mv children are being educated at home — as long as it's understood I'm not asking his permission to do this.” The board vote came two days af ter Gov. Mark White told Chairman Jon Brumley that “an issue of this importance, with many ramifica tions, should he left in the hands of the members of the Legislature.” More than 1,()()() people, includ ing many fundamentalist Christians, packed a Thursday public hearing on the proposal. Board members Geraldine Miller of Dallas and Volly Bastine of Hous ton \oted against the resolution Sat- ttrday. They wanted to drop the guidelines. They also wanted to urge lawmakers to handle the issue them selves and not kick it back to the board. Bastine said, “It makes me sick for us to sit here and trv to justify our actions this morning. Even State District Judge Enrique Pena was hard pressed in deciding that Jesus Soltero Jr. will stand trial as an adult. Because of his age, the bov is charged only with juvenile de linquency, El Paso detective Alfred Giron said, “but we’re trying for cap ital murder." A ninth-grader at Henderson Ju nior High School, Soltero was not the outgoing type, but he never had a discipline problem, witnesses said. His lowest grade was an 83 in En glish and he played in the band. Eests showed Soltero to have above-average intelligence and a po tential for creativity. Psychologist Richard Walker said he also is emo tionally reserved. “If you handed me this data and I did a blind analysis, 1 wouldn’t pre dict crime,” Walker testified. Psychiatrist David F. Briones, who examined Soltero when the boy was hospitalized after his arrest last month, agreed with Walker. Neighbors say they often saw Sol tero and his best friend and school mate Fabian Gastorena, 15, walk home from school together to their working-class neighborhood. Gastorena, his 11-year-old sister. Ruby, and their parents, Jose, 3(>, and Luz Elena Gastorena, 34, were found shot to death at the family apartment March 8. They had been dead for about two davs, police de termined.
