Eubank, professor of chemistry, was named he 1983-84 Brockett Professor Engineering. The Halliburton Foundation, Inc. of Dallas presented Dr. Robert H. Page, dean of engineering, with a $30,000 heck for faculty support. A portion of the donation from Halliburton was pre- ented to three faculty members for excellence. They were Dr. Guy L. Curry, professor of industrial engineering and gricultural engineering; Dr. Sallie B. Sheppard, associate Drofessor of computing science; and Dr. Mogens Henrick- ion, associate professor of mechanical engineering. Brazos County assistant pro- Decline shown in well activity United Press International DENVER — An industry organization Wednesday said 59,214 oil and gas wells were completed in the United States in the first three quarters of 1983, a 7.7 percent decline from the same period last year. But Petroleum Information Corp. said 1983 drilling activity, while behind the record 1982 pace, remained “relatively strong.” PIC said the largest decline was in new field wildcat or ex ploratory drilling, where there were 5,950 completions, a drop of 20 percent. Those drillings produced 586 new oil fields and 452 new gas fields, compared to 845 and 568, respectively, in the first nine months of 1982. Texas continued to be the top drilling state with 18,284 com pletions. Oklahoma remained second with 7,488, followed by Kansas 5,343; Louisiana 3,810; Ohio 3,741; Kentucky 3,148- Suit will be re filed against gynecologist United Press International AUSTIN — A woman whose gynecologist allegedly left a sponge inside her body during an operation may re file a medical malpractice suit against the physician, the Texas Supreme Court ruled Wednesday. A trial court and appeal courts in Fort Worth had dis missed the suit filed by Irene Wood against Dr. John F. Hutchinson because the woman had failed to give the physician the required 60 days notice that a suit would be filed. However, the Texas Sup reme Court overturned the lower courts’ dismissals, per mitting Wood to refile her suit with the proper two months notice. Hutchinson operated on Wood in June 1979 to correct a problem with cystitis and en dometriosis. Ten months la ter, Wood complained of a knot on her left side, and x- rays showed a sponge had been left in her body. Man injured in refinery More damages awarded United Press International AUSTIN — The Texas Sup reme Court awarded $515,718 in damages Wednesday to a Jef ferson County man injured in a refinery accident, even though lower courts had awarded the man less than half that amount. Robert O. Varela, who was employed by Hydrocarbon Con struction Co., was injured in a fall at an American Petrofina Company of Texas refinery. After settling his claims with Hydrocarbon’s workers com pensation insurance carrier, Varela then sued Petrofina. A trial-court jury ruled that Varela was responsible for 15 percent of the negligence that led to his accident and that Hyd rocarbon and Petrofina were re sponsible for 42 percent and 43 percent of the negligence re spectively. The jury also found that Varela suffered $606,800 in damages and awarded him $243,924, a sum equal to Petro- fina’s 43 percent share of negli gence. At issue before the Supreme Court was whether the negli gence attributed to Hydrocar bon could be considered in awarding Varela damages in the suit against Petrofina. In its ruling the high court ordered that not only was Petro fina responsible for its share of the damages awarded, but also that it had to pay for the negli gence attributed to Hydro carbon. Keel said the child was assaulted over a three- year period, with the assaults in cluding forced oral sex. Jolly’s attorneys, W.W. and W.R. Vance, asked for proba tion saying Jolly was a middle- aged working man who had nev er been convicted of a crime be fore. Under a law that went into effect last month, the child was able to testify against her step father on videotape without being present. Police learned of the case from the child’s mother on Oct. 29, 1982, authorities said.
