Yarbrough, who faces a five-year prison sentence for lying to a grand jury investigating forgery allegations against him, wants permission to leave the coun try to attend medical school in the Caribbean. Former Attorney General Wag goner Carr, Yarbrough’s chief attor ney, asked District Attorney Ronald Earle if he would oppose the move, and said he has not yet had a re sponse from Earle. Earle declined comment to the news media. Yarbrough is free on bond while awaiting the outcome of the appeal of his conviction, and needs the approval of District Judge Mace Thurman to leave the country. The judge said he had informed Carr that Yarbrough would have to file a written application for permis sion to leave the country. I asked the district attor ney to see what their attitude would be.” Yarbrough, 38, was elected to the Supreme Court in 1976 in one of the state’s major political surprises. Many political observers said Yar brough’s election was due to the similarity between his name and that of former governor candidate Don Yarborough, also of Houston. He resigned from the court in July 1977 as the Legislature began pro ceedings to remove him from office, and in January 1978 was convicted of lying to the Travis County grand jury. His appeal of that conviction has been pending in the Court of Cri minal Appeals for almost 18 months, and may not be heard before the end of the year. Kurachi, 28, of Orem, Utah, tele phoned his parents Wednesday from St. Johns, Newfoundland, where he plans to begin his voyage to Ply mouth, England. “We ll be thinking of him and praying for him," said his mother, Kumi Kurachi. “But I’m not wor ried. I honestly didn’t worry about him last time.” The former Austin resident failed in a 1977 attempt to row a larger boat from North Carolina to England. That journey ended after seven weeks at sea when a storm cracked his fresh-water container and Kurachi radioed an SOS to a nearby ship. Kurachi survived uninjured but his boat sank.
