Thomas Lloyd Gerry, about 32, ■also known by the Bandido aliases “Hammer and “Lefty,” was arrested in Denver earlier this month and was being held on a fugi tive warrant issued in Irving. However, Assistant U.S. Attorney Wayne Speck said Tuesday the fugi tive warrant had to do with a state murder conspiracy charge in the Northern District of Texas. Speck said federal authorities were not saying whether Gerry was a suspect in the Nov. 21, 1978, attempted assassination of former Assistant U.S. Attorney James Kerr. “I sure haven’t suggested that to a living soul,” Speck said. “Who the FBI is investigating, you’ll have to get from the FBI, if you get it from anybody, because we will not discuss it.” Kerr, a crack prosecutor of narco tics cases in the Western District of Texas at the time someone fired 19 automatic rifle bullets into the front of his automobile at a San Antonio intersection, since has resigned and is staying in an unknown location. Six months after the attack on Kerr, U.S. District Judge John Wood Jr. was shot in the back and killed outside his apartment about a mile from where Kerr escaped with minor glass cuts. Wood, nicknamed “Maximum John’’ because of the stiff penalities he assessed, presided in many of the same narcotics cases Kerr prosecuted. The Bandidos, who last year estab lished a chapter in Colorado, are also considered suspects in Wood’s kill ing, police in Denver said. The FBI has conducted the most massive investigation since the assas sination of President John F. Ken nedy, but no one has been charged directly in either the Kerr or Wood case. Detective James Wattles of the Denver Police Department said Tuesday that Gerry was one of six Bandidos suspected of conspiring to kill Kerr and was being detained as a suspect in that case. State bond of $250,000 has been set on the murder conspiracy charge against Gerry, and Speck said proce dure is for federal officials to drop the fugitive complaint once a suspect is in custody of local authorities. Dollar up, gold down United Press International LONDON — Commercial de mand boosted the dollar on most European money markets Tuesday, but the price of gold fell back. The price of an ounce of gold fell $15 in Zurich overnight to $545.50 and dropped $21 in London to $544.50. The decreases wiped out the $15-$20 gains established during Monday’s trading. Commercial buying demand strengthened the dollar on the money markets. In Frankfurt, the dollar opened at 1.8950 marks, up from 1.8880 in brisk but somewhat nervous trading, dealers said. In Zurich, the dollar opened at 1.7922 Swiss francs against 1.7833 overnight, and in Amsterdam it strengthened to 2.0760 guilders from 2.0665. In Paris, a dollar was worth 4.4012 francs compared with 4.3850 Mon day night, and the rate in Brussels was 31.67 Belgian francs up from 31.5250. In Milan, the dollar im proved to 883.50 lire up from 879.70. The pound opened higher in Lon don at $2.1915 against $2.1835 Monday. Texaco adds credit charge United Press International HOUSTON — Texaco Inc. has announced it will assess its dealers a 3 percent surcharge on non-gasoline purchases paid by credit card. Blaming the charge on “the rising cost of credit and carrying receiv ables,’’ a company spokesman Mon day said the surcharge could not be entered as a line item on a credit card bill, but that it likely will show up at the pump. Federal regulations do not allow a similar surcharge on gasoline purch ases, the spokesman said. Rebels flee to Thailand United Press International BANGKOK, Thailand — Thousands of Burmese rebels have streamed across the border into Thailand to flee an army drive against them in their homeland, re ports from the frontier said Tuesday. Rebel sources said the guerrilla headquarters at Wang Kaew, 230 miles northwest of Bangkok on the Burmese side of the border, came under mortar and rocket fire over the weekend. There have been no re ports of casualties. Thai officials at the village of Mae Sot across the river boundary in Thailand said the riverbank settle ment was mobbed by about 4,000 rebels by late Sunday. Wang Kaew houses the Karen guerrillas’ commando camp 101, headquarters for the resistance movement against the Burmese gov ernment of President Ne Win. The focal point of last weekend’s attack was Sawill, the center of a log ging operation three miles from Wang Kaew. It was the fourth year in a row the Burmese have struck out in spring drives against rebel groups. Dog la w held constitu tional United Press International AUSTIN — Williamson County’s dog destruction ordinance is not un constitutional, Attorney General Mark White said Tuesday. White said the ordinance adopted by voters of the central Texas county does not violate constitutional pro tections against taking of property without due process. The ordinance provides for the destruction of dogs known to have attacked livestock or other domestic animals. The county attorney, Bill Stubble field of Georgetown, asked White to rule on the constitutionality of the ordinance and to set out standards for determining that a dog had attacked livestock. White declined to rule on the second question, saying it was a mat ter he could not decide.
