The high court rejected a move by Wynn Oil Co. of Fullerton, Calif., to prohibit District Judge James F. Dear of Austin from re quiring the company to disclose the names of all customers who have purchased Wynn X-Tend Warranty kits in the past four years. The Texas distributor for Wynn told UPI 600 to 700 of the kits are sold each month by auto dealers ac ross the state. The kits — containing eight 11-ounce cans of oil, two 15- ounce cans of transmission treat ment, two 4.25-ounce tubes of lub ricant, and two 11-ounce cans of radiator coolant — sell for $189 cur rently, according to Pete Arnold of Warranty Protection Co. of Austin. Marcela Goodhue of Austin went to court after she paid $169 for the warranty kit last year. The car salesman told her it would extend the warranty on her new Buick from one year or 12,000 miles to three years or 50,000 miles, she said. The warranty, according to her suit, is worthless because it covers only damage caused by the Wynn products. Wynn asked the Supreme Court to bar the trial judge from treating Goodhue’s suit as a class action. The suit is believed to be the first to reach the state’s highest court since new rules of civil procedure went into effect on Jan. 1, 1978, al lowing private individuals to bring class action suits. Goodhue said the car salesman at an Austin Buick dealer told her thousands of motorists had purch ased the warranty kits from dozens of dealers across the state. “Not all dealers have availed themselves of it but most have, ” the distributor said. Arnold said dealers receive $84 of the $189 purchase price. “The warranty covers everything that Wynn products cover — the motor, the radiator, cooling system and transmission system,” Arnold said. He said customers with claims can call the Wynn company in California and get authorization to have any repairs made. Wynn Oil Co., a subsidiary of Wynn’s International Inc., has been marketing the warranty kits since 1973 according to papers filed in the suit. Arnold said Texas sales of the kits began Sept. 1, 1975.
