Electronic gates at an estimated cost of $5,000 apiece are under order. Lot 13 behind the Chemistry Building will operate on a card- punch system. Lot 34 behind the Plant Sciences Building will operate on a system which will open the gate* when the correct number is typed on the machine. Traffic panel member Barry Brooks said the first two gates will be on a trial basis. Installation is expected in approximately six weeks. It was brought to the attention of the Traffic Panel that unless the no-parking regulation in the picnic area south of lot 60 (near the au ditorium) is enforced, the trees in that area will be dead in four or five years. These trees have an esti mated worth of $90,000. It was requested of the Traffic Panel that the reserve hours for lot 34 be extended to 10 p.m. Brooks said that because the lot is close to the library, for the student’s sake, the present 8-5 hours will remain. The police have been notified to discourage cars from parking in fire lanes and other illegal spots in that area. Also discussed at the Traffic Panel meeting was carpool policy. The current fee structure is $4 per car- pool car as opposed to $36 for other. There are about 200 carpools, this means approximately 500 fewer cars on campus. The panel decided the reduced rate incentive is justified consid ering what is saved in traffic, Brooks said. | Harper for Military Day Brigadier Gen. George R. (AP) — The Texas Supreme Court ruled Wednesday a doctor can be held liable for a defec tive child’s medical bills if he failed to warn its mother that she had German measles during pregnancy. The decision cleared the way for a jury trial of Mr. and Mrs. George S. Jacobs’ negligence suit against Dr. Louis M. Theimer of Wichita Falls. Mrs. Jacobs said Theimer assured her that an illness she had in the first three months of her pregnancy was not German measles, a cause of birth defects. She gave birth in March 1969. Had she known she had German measles, she would have obtained an abortion in a state or country where abortion was legal at that time, Mrs. Jacobs said. A Wichita Falls trial judge and the Fort Worth Court of Civil Ap peals ruled there was no basis for a suit since Mrs. Jacobs’ only recourse — knowing she had German measles — would have been an abortion, then illegal in Texas. But the supreme court said, “There would have been no crimi nal liability unless the doctor ad vised the plaintiffs to commit an il legal act and unless the illegal act were committed.” Dr. Theimer, it said, had a duty to disclose to Mrs. Jacobs that she had German measles, as well as the risks entailed in continuing her pre gnancy. The couple sued for damages for their mental suffering as well as their medical expenses, but the court said only the medical costs could be recovered in court if the jury found Theimer negligent. “It is impossible for us to justify a policy which at once deprives the parents of information by which they could elect to terminate the pregnancy likely to produce a child with a defective body, a policy which in effect requires that the de ficient embryo be carried to full ges tation until the deficient child is born, and which policy then denies recovery from the one who causes an injury of costs of treating and car ing for the defects of the child, ” the court said. Calypso cruise ends for Ags Four TAMU graduate students will begin the final leg of a research cruise on board Capt. Jacques Cousteau’s “Calypso” this week. The researchers are working to determine if it is possible to study the ocean from aircraft and satel lites. Part of their research on this leg of the voyage will include taking water samples and ground truth meas urements to be correlated with data obtained by satellite.
