The subcommittee, however, put off action on sterilization and abortion bills for at least a week. Rep. Tim Von Dohlen, D-Go- liad, said he wanted time to per fect a substitute bill that would outlaw abortion in state-licensed and tax-supported hospitals and make it murder to abort a fetus that had been carried 18 weeks or longer. A 5 to 1 subcommittee vote sent the contraceptive bill to the full House Human Resources Committee for further action. It would permit a woman be tween 16 and 21 to receive preg nancy care and contraceptive measures from a physician with out the doctor having to get the consent of her parents, as pres ent law requires. Girls under 16 also could re ceive such care without parental permission if they were living away from home or their parents could not be located. Chris Miller, D-Fort Worth, tried to require the mi nor’s consent before her parents could be informed, but was out voted 4-1. “We are symbolically saying that we recognize the solidity of the family but we also recog nize there are some problems,” said Rep. Lyndon Olson, D-Waco, who opposed Ms. Miller’s amend ment. Rep. Ben T. Reyes, D-Houston, tried to strike a provision allow ing a doctor or other person to refuse on religious grounds to provide contraceptive measures. “I don’t think you should have a religious reason. If we start getting into that we’ll be starting to legislate morals,” Reyes said. “It is a person’s right to have that professional right at this time,” said Von Dohlen, a Ro man Catholic. Reyes’ amendment was tabled 4-1. The sterilization bill provides that a doctor would not be liable for damages if he sterilized a man or woman without his or her spouse's consent. The subcommittee deadlocked 3-3 on motions to table the meas» ure and to send it on to the full committee. Rep. Eddie Bernice Johnson, D-Dallas, the chairman, did not vote, leaving the tie in tact. Rep. Tom Schieffer, D-Fort Worth, disagreed with assertions Bentsen, Tower Differ On Bill WASHINGTON <A>) _ Sen. Lloyd Bentsen voted with the majority and Republican Sen. John Tower voted against it in the 70-24 roll call vote by which the Senate Wednesday approved the part of Sen. Sam J. Ervin’s D-N.C., amendment that would curb presidential impoundment of funds appropriated by Congress. The Senate Wednesday defeat ed 69-23 a move by Tower to ta ble and thus kill Ervin’s amend ment combining a $268 billion spending ceiling for next year with a permanent curb on presi dential impoundment of appro priated funds. Bentsen voted for defeat of the motion. that such legislation is needed by persons who are separated from their spouses or have been de serted. “We have a remedy through the courts for divorce. I think the common law which requires consent of the spouse is correct in this area. The marriage con tract is such that it requires con sent of both persons,” Schieffer said. Von Dohlen’s proposed abor tion law apparently would leave physicians free to perform abor^ tions in their own offices or clin ics. But it would add consider able red tape, including manda tory reports to the State Health Department. Saline injection and hysteroto mies—surgical removal of a fetus — would be prohibited. If an aborted fetus was living when removed, a doctor would have to notify the State Board of Health and obtain a birth certifi cate for it. The fetus automati cally would be determined to be a “dependent and neglected child” and the state attorney general would be required to seek out proper care for it.
