His 16-year-old daughter, Cheryl Dee Fergeson, was raped and stran gled Aug. 23, 1980, while attending a volleyball tournament at Conroe High School. Brandley, a janitor at the school, was charged with the crime a week later. He was tried twice for capital murder. The first trial ended in a mistrial and the second with a con viction and a death sentence. Tuesday, Brandley walked out of Texas’ death row after the Texas Court of Criminal Appeals last month set aside his conviction. The court said he did not receive a fair trial. “I’m still convinced he’s guilty, and I hope (Montgomery County District Attorney Peter) Speers is going to do everything he can to rec tify the situation,” Fergeson told the Houston Chronicle from his home between Bellville and Brenham. Fergeson, 59, said the thought of Brandley being free on bond is frightening. 1’m not worried about him while the spotlight’s on him, (but) as soon as the spotlight fades ... ” he said, his voice trailing off. “After all that’s passed — with the news media and all the protests and the evidence and everything — I think probably a new trial would be pointless,” Fergeson said. “Right now, it’s up in the air. You always hope the next step will be different. “This is our appeal,” he said of Speers’ decision to seek a U.S. Su preme Court review of the case. “We don’t have any other appeals. I left it up to the courts and the jus tice system,” Fergeson said. “As far as I know, they’re still working at it. Some people are losing faith in it, but I think it may turn out all right.” Fergeson, a retired steel company official and now a sculptor, said he feels bitter about the last 9'/2 years. Callers turn in own pushers during anti-drug broadcast DALLAS (AP) — More than 1,000 anonymous call ers turned in neighbors, friends, schoolmates and their own drug pushers during an unprecedented anti-drug broadcast here, crime officials said. “It went far beyond my greatest expectations,” said Greater Dallas Crime Commission Director Greg MacAleese of Tuesday night’s “Texas Crackdown!” an anti-drug program broadcast by four television and three radio stations. “We took over a thousand tips, and a very quick scan of them would indicate 20 to 25 percent of them really look good,” MacAleese said. “If that’s the case, that’s probably 200 to 300 drug dealers who’d better enjoy their last few weeks,” he said. The tips came from schoolchildren, neighbors of sus pected drug pushers and even from drug users them selves. “Revenge is a major factor,” MacAleese said. “Push ers will rip people off left and right, phony dope, this type of stuff, so there were a lot of guys out there who were getting even.” Local TV executives say overnight ratings showed al most three-quarters of the people watching television in Dallas-Fort Worth Tuesday night were watching the lo cally produced special that pre-empted network pro gramming. An hour-long “town meeting” followed local new casts at 10:30 p.m. The program was produced by and aired on WFAA TV, an ABC affiliate, CBS affiliate KDFW and NBCaf filiate KXAS. It also aired on independent KDTX-T': and was translated onto three Spanish-language radiol stations, KESS-AM. KSSA-AM and KSSA-FM. More than 1,000 calls came in to the so-called Tipstei hotline during the broadcast, and to a help line staffec! by drug counselors. Drug users and those seekinghel[ for drug users were referred to support groups an! treatment centers. MacAleese said producers shunned sensationalismti show the effects of drug use on individuals. Organize!: said the show’s emphasis was on education and commi nication, especially among young people. “We were not naive enough to believe that you a take people who are hooked on crack cocaine, put thee in front of a TV and cure them,” said Dave Lane, pres; dent and general manager of WFAA-TV. “I don’t know if we cured a soul, but if we made the: think, and showed them where to get help, I think*: did what we set out to do,” said Wendell Harris, vie president and news director at KDFW-TV.
