Order your Graduation Creation theories subject of federal court battle V4 United Press International LITTLE ROCK — The San Diego based Creation Science Re search Center wants to assist Attorney General Steve Clark, who has the task of defending Arkansas’ unique “creation- science” law, now challenged in federal court. The American Civil Liberties Union tiled suit in federal court claiming the law violates the con stitutionally guaranteed separa tion of church and state. The San Diego center fought a similar battle in California courts several months ago, and sharing its information with Arkansas could save state attorneys “years of research,” said Nell Segraves in a telephone interview. Her son, Kelly Segraves, di rects the . San Diego center. He and his teen-age son, Kasey, filed a suit in California — billed as a modern-day Scopes Monkey Trial — to challenge the teaching of evolution as hostile to religous be liefs. A California judge ruled schools must observe a 1973 policy requir ing evolution be taught as theory rather than fact. The ACLU was joined by reli gious leaders including the Catho lic and Methodist bishops in Arkansas as plaintiffs in the suit. The new law requires the biblical account of creation he discussed whenever evolution is discussed in public schools, although reli gion is not to be mentioned. “I don’t see how they have a ghost of a chance challenging this particular bill,” Mrs. Segraves said. “It is thoroughly philo sophically oriented toward policy under the constitution. If they’re going to nullify the constitution and the Bill of Rights as it protects religious beliefs, I don’t think they’ve got a leg to stand on in court.” The Arkansas law is better than most, Mrs. Segraves said, because it does not mandate the teaching of evolution or creation-science. “You can have an excellent sci ence program without ever having to refer to origins ever,” she said. Mrs. Segraves said she is not necessarily in favor of balanced treatment for creation-science and evolution — a popular perception of the desires of fundamentalist Christians. “I don’t want evolution frozen in concrete in equal time with creation.
