An appeal must be filed based on one of three reasons: • the fraternity was found in vio lation of rules it did not violate • punishment was too severe •fraternity did not recieve due process As of Thursday afternoon, Paterson said, he had not received an appeal. Paterson and Blackwell declined further comment pending the appeal time period, which expires today. Courtney Reece, Sigma Nu com mander and a senior geology major, said the fraternity plans to file its ap peal today. He said the fraternity plans to ar gue that its punishment was too harsh and possibly that the findings were inappropriate. “We are waiting on our appeal process,” Reece said. “We feel that it was too harsh of a sentence. We are going to go before Dr. Paterson, and his decision is final.” Kim Novak, coordinator of Stu dent Conflict Resolution Services, said individual charges were filed against eight of the fraternity mem- j bers in addition to the sanctions against the fraternity. Collectively, the charges included A&M student rule violations on re- i taliation (section 24.3.4.4), hazing ' (section 24.3.3), alcohol (section 24.3.8) and being an accessory to a student rule violation (section 24.3.23). The charges were different for each of the eight students. Novak said seven of the students were not found in violation because of “preponderance of evidence,” which means that not enough evidence was present to confirm the allegations. Reece said the A&M chapter of Sigma Nu has been working with officials from the fraternity’s na tional headquarters. “We are trying to get this re solved for the best for all parties in volved,” he said. Putnam said the University fo cuses on giving everybody “unfet tered access.” “We provide access to the Internet and we do not spy on our people.” Lane Stephenson, deputy direc tor of the Office of University Re lations, said the University expects network users to operate within the framework of the law. Putnam said there are other ways that copyrighted material can be shared and the University cracks down on these cases when they are found to be illegal. For instance, Uni versity officials are often alerted to Websites that illegally share maten-, als by the disproportionate numberof' “hits” that the site receives. In sud cases, the University investigates the activity and takes action against the unlawful individual. Putnam added that the University investigates only when network abnormalities are ev ident. He also said that not all users of Napster use it illegally. King said that about 40 percent of the universities that he has talked to have banned Napster. On Sept. 22, six universities an nounced that they would not block access to Napster on their networks. Yesterday. Harvard officials they, too, would refrain from block ing access to Napster. “I plan to continue dialogue with the other universities and see if 1 can persuade them to see the error of their ways,” King said.
