But in Friday's ruling, the appeals judges said "substantial questions" had been raised about "the merits and form of the injunction." The ruling means Napster can remain in operation at least the lawsuit goes to trial; no date has been set. The RIA A could still appeal the decision to the 9th U.S. Circuit Court of Appeals or the U.S. Supreme Court. Napster employees screamed jubilantly when Friday's ruling was announced. Users of the site took to the chat rooms, thumbing their virtu al noses at the recording industry's legal setback. "We're probably breaking the law, but we have to continue," said John Marcinik, 42, of Deale, Md., as he dis cussed the decision in a Napster chat room. "Obviously there's a market segment not being met. I'm on here looking for old '70s music that you just can't find anymore." Before the stay, tens of thousands.. of Napster users had pledged to boy? cott the recording industry in retalia tion for its lawsuit. On one Website, more than 75,000 people had signed an electronic peti tion vowing not to buy music unless the RIAA dropped its lawsuit against Napster. That would cost the indus try more than $1 million if each refused to buy just one $15 CD. Alternative software to Napster was also a hot topic Friday, and many software developers accelerat ed work on'substitute music sharing programs as the witching hour for Napster approached. But Napster is alive, well and popular as ever — for now. Fanning's ingenious "small pro ject" — a quick and easy method to exchange music in MP3 format with others online — quickly grew from meager dorm-room beginnings to an international phenomenon with more than 20 million users sharing millions of songs for free each day. noming in a bus w tay you $10 to com soften turned dov tis offer. "It has been pretty successful, but we have a long way to go in getting more people involved," Johnson said. Johnson said College Station is at a disadvantage because, with the high number of college students in town, neighborhoods tend to change frequently. "With a college town, students move around almost every semes ter in some cases," Johnson said. Johnson said she knows of four confirmed scheduled block parties, but every year neighborhoods organize events without telling the department, so there are probably more parties planned. The CSPD and other local law enforcement agencies will be on hand Monday for a kickoff gather ing at 5 p.m. in the Sears/ Dillards court area of Post Oak Mall. Prizes will be given away by local police officers, and McGruff the crime dog will attend. Johnson said the kickoff is a good time for police officers to address citizens' questions and concerns.
