WASHINGTON (AP) — The sexual misconduct case against Sgt. Maj. of the Army Gene McKinney moved within a step of tri al Wednesday when a re viewing officer concurred with a recommendation that McKinney be court- martialed. Col. Owen Powell sent his report to Maj. Gen. Robert Foley, who will make the final decision on whether McKinney should stand trial. Six women have alleged that McKinney made im proper sexual advances to ward them. All six testified at a Fort McNair hearing to deter mine if there was sufficient evidence to order a court- martial. McKinney, the Army’s top enlisted soldier, has denied all the allega tions. Powell, commander of the Fort iMyer Military Community, ordered the hearing and appointed Col. Robert Jarvis to pre side. The proceeding lasted eight weeks, one of the longest such hearings in Army history. Jarvis recommended that McKinney be court- martialed on 22 counts, including indecent as sault, adultery and ob struction of justice, and sent his report to Powell for review. The Army has refused to say what either Jarvis or Powell recommended. But sources close to the case, speaking on condition of anonymity, confirmed that both officers recommend ed the matter go to trial. The brief Army an nouncement said that Foley could dismiss the charges, order nonjudi cial action, return the case to Powell for dispo sition or order a general court-martial. Charles Gittins, McKin ney’s civilian lawyer, has said that if a court-martial is ordered he will file a mo tion detailing cases in which general officers ac cused of the same activity alleged against McKinney were not threatened with prosecution. He said the officers were allowed to re tire with full benefits. The charge against South Korea came despite llth-hour negotia tions held over the past several days in which the South Koreans sought to keep from being singled out under a provision of U.S. trade law known as Super 301. That provision allows the presi dent to launch investigations of un fair trade practices against coun tries and to impose punitive tariffs if negotiations to remove the barriers are not successful. U.S. Trade Representa tive Charlene Barshefsky announced that such a case was be ing brought against Korea because negotiations between the two countries had failed to resolve all of the U.S. complaints. “Korea was not prepared to under take the reforms that are necessary for Clinton real opening of their auto market, Barshefsky said in a statement. She said despite South Korea! commitments in 1995, salesoffor eign cars make up less that 1 per cent of the Korean market. The U.S. auto industry hat urged that both South Korea am Japan be cited as part of the ministration's annual Super 3(1 review, a process by which it tar gets countries deemed to havi erected the most harmful barrier against American products. Instead, it cited Japan, Canada the 15-nation European Uniot and Australia for other alleged fair practices. Computer mogul headed to court AUSTIN (AP) — Computer company founder Michael Dell is headed to court over the property tax appraisal on his new, 33,000- square-foot house. The Travis Central Appraisal District says the house, located on 60 acres of prime land west of Austin, was worth $22.5 million on Jan. 1. The tax bill would be about $600,000. Art Cory, chief appraiser for thn district, acknowledges that the ap praisal might not be accurate. Ap praisers haven’t been allowed on the property, he told the newspaper “We’ve made every reasonable attempt to get on the property, and we’re still getting denied,” Cop said. “I understand Mr. Dell’s con cern about security. But at the same time, it’s difficult to appraise a piece of property without bein? able to look at it.” The Dells’ lawyer said they were making arrangements to let coun ty appraisers onto the propertyin the next week.
