Smith said he has faith and con fidence in the justice system to dis cover the truth. “I think justice will prevail,” Smith said. DeGuerin also said he will obtain some evidence that the prosecution has that is favorable to Smith. “The prosecution has to give over some grand jury testimony fa vorable to Smith,” DeGuerin said. “Some of this evidence exonerates Smith.” “I am not trying to hide any in formation,” Turner said. Turner said Smith’s case is not over. “We went in and argued our case today and the judge made his decision based on our statements,’ Turner said. “We have charged Smith as a government official,and Texas A&M’s contract with Bams and Noble fits the definition^ what a government contract is." “1 will refile this case first thing tomorrow,” Turner said Wednesday.
