'V A A z \ 1 JCj Thursday • October ■rsday- Verdict reversed on convicted murdei ■ • ■ Death penalty only for two- time offenders AUSTIN (AP) — The Texas Court of Criminal Appeals to day reversed the conviction of a man sentenced to death in the brutal slaying of an 81-year-old widow in Tarrant County. The court cited a jury selec tion error in overturning the verdict against Charles Richard Sonion, who was found guilty in the 1988 kidnapping and slay ing of Ora Pearson, a neighbor in Azle. Before Mrs. Pearson died, a handgun was inserted in her vagina and she was shot six times, according to court records. She also was struck in the head and stabbed in the chest. Her death was caused by a stab wound that cut her aorta above her heart, court records say. Her body was found in a field. Sonion, who according to prosecutors had confessed, did n’t challenge that the evidence supported a guilty verdict. A le gal brief filed by the defense said he had a history of mental problems and had hit his head before the crime. But in an argument accepted by the appeals court, he said the trial judge was wrong to dismiss a potential juror who was challenged by the prosecu tion after she stated it would take more than the facts of the case to persuade her that a de fendant was a continuing dan ger to society. A defendant must be found to be a continuing danger for the death penalty to be im posed. The nine-member criminal appeals court — with two judges dissenting and two not participating — said a previous case has determined that such a dismissal is grounds for re versing a conviction. Among other arguments, the prosecution said the mistake was harmless because prosecu tors could have asked for the potential juror’s dismissal with out giving a reason. In selecting a jury, each side is given a cer tain number of challenges that are automatically upheld. But the Court of Criminal Appeals, voting 5-2, reversed Sonion’s conviction and ordered the case returned court, where anothu would be required to him again. He nocent by reason ofinsarj Crop fraud unveiled in Harlingen BROWNSVILLE, Texas (AP) A prominent Harlingen farmer was sentenced to 15 months in prison Wednesday for defrauding the govern ment out of nearly $300,000 in crop in surance. U.S. District Judge Filemon B. Vela also ordered Allan R. Anderson, 44, to pay $195,000 in restitution and serve three years of supervised release when he gets out of prison. Anderson pleaded guilty in April to mail fraud involving the Federal Crop Insurance Corp. and filing a false claim to the Agricultural Stabilization and Conservation Service. “The good thing about this case is that I’m hearing from the ASCS that farmers are being more careful,” said Assistant U.S. Attorney Laura Hubert Surovic. However, Mrs. Surovic said Ander son’s offenses constituted far more than sloppy bookkeeping. During 1989 and 1990, Anderson underreported the size of his cotton, sorghum and corn harvests to the government. That allowed him to receive $203,000 more in federal crop insur ance and $89,000 more in disaster benefits than he was entitled, Mrs. Surovic said. Meanwhile, he reported his real harvest figures to his bank. “These kinds of cases remind us that this is taxpayers’ money. These are government programs, and they have to be applied for in good faith,” Mrs. Surovic said. In urging a light sentence, defense attorney Christopher Lee Milner asked Vela to consider that his client had admitted guilt and taken steps to pay back the government. Vela imposed a sentence that fell directly between the federal sentenc ing guideline range of 12 to 18 months.
