Banned Japanese wire tato from company to highway THE ASSOCIATED PRESS dollars, the newspaper said Dave Q THE ASSOCIATED PRESS HOUSTON - Thousands of tons of Japanese-made steel wire have been channeled from a Houston company to dozens of state highway projects, violating federal and state laws that require the use of American-made prod ucts, according to a copyright re port Sunday. Industry sources and records obtained by the Houston Chroni cle indicate the Texas Department of Transportation, whicn builds and maintains highways and bridges, has failed to enforce the federal Buy American Act since the mid-1980s. The infraction puts the depart ment at risk of being fined and losing millions in federal highway dollars, the newspaper said. Billy R. Neeley, director of ma terials and tests for the highway department, said the state doesn't enforce the law because it has a lack of manpower and equipment. "We're counting on their word (that) it's domestic cable, and if they are lying they're getting away with it," Neeley said. The manufacturer is Shinko Wire America Inc., the Houston subsidiary of Shinko Wire Co. Ltd., based in Amagasaki, Japan, near Kobe. The Chronicle obtained inven tory and production documents from Shinko with notes telling how to mix Japanese Kobe steel with American-made Bethlehem steel in making seven-wire strand, used primarily in concrete beams for highways. The order from Judge Martha Tanner hides the identity not only of the victims and their parents, but of the defendants as well. However, the defendants, who agreed to undisclosed insurance settlements, include a private psy chiatric hospital and a retail busi ness establishment, the newspa per reported. The names appeared in public records of the criminal cases. Tanner set a hearing for 8:30 a.m. Wednesday to rule on whether the records will be sealed permanently. In an interview last week, the judge said she is unsure how she will rule. "I have a bad problem with it (the sealing request)." the judge said. "I will have to weigh that against the rights of an innocent child. I didn't seal the records for one minute to protect the hospital. If there is no objection, I will prob ably seal it." The personal injury lawsuits al lege sexual assaults on a 15-year- old boy and on a 10-year-old boy by a 27-year-old social worker, the newspaper said. The social work er has been indicted on two charges of aggravated sexual as sault. The man's court-appointed at torney said his cliept is terminally ill with AIDS.
