Boy saves drowning 1 -year-old LUBBOCK (AP) — A Lubbock boy pulled his 1-year-old cousin from a swimming pool after the baby girl fell in and nearly drowned during a weekend birth day party. Heather Fisher fell into a swimming pool during a birthday party Saturday. Pam Carr, the child’s aunt, said Heather fell in as the party was ending. “We were all getting ready to leave and turned our heads for just a second when she toppled in,” Carr said. Chris Carr, her 11-year-old son, quickly leaped into the pool and pulled Heatner to safety. Heather “already was purple and not breathing,” the boy’s mother said. An adult at the party per formed cardippulmonary resusci- taftion on the child and revived her immediately, she Carr said. Officer killed by parolee Wife seeks to change system AUSTIN (AP) — The widow of a Houston police of ficer killed by paroled seven-time convict Carl Wayne Buntion is seeking permission to sue the state for neg ligence. Maura Irby, 29, blames the state for the June shoot ing death of her husband, 18-year police veteran James Irby. Buntion killed Irby while he was on parole after serving three years of a 15-year sentence for sexually assaulting a teen-age girl. Buntion had been in and out of jails and state prisons for nine previous crimes and was violating his parole when he fatally shot Irby. A Fredericksburg jury sen tenced Buntion on Jan. 24 to die by lethal injection for the murder. “Somebody should be responsible for what hap pened to my husband,” Irby told the Austin American- Statesman. “There is no reason this should have hap pened in the first place.” The former nurse has given up her job so she can work full-time trying to change the criminal justice sys tem. She also is raising the couple’s two children, Cody, 3, and Gaily, 18 months. Seven months after her husband’s murder, Irby has come to the Capitol, requesting permission to file a law suit against the pardons and paroles division of the Texas Department of Criminal Justice for failing to monitor Buntion’s whereabouts while he was on parole. The state has legal immunity in most cases, and law makers grant very few people the right to sue the state, mostly because of budgetary constraints. Sen. Gene Green, D-Houston, is drafting a resolution that would allow Irby to press forward with a lawsuit, but he admits “it’s going to be tough” to pass. David Young, assistant director for pardons and pa roles, said the parole board looked at Buntion’s crimi nal history, which mostly included property crimes like auto theft, theft and burglary. His only known violent offenses were the sexual assault and an incident in which he tried to run down an Alabama deputy. The state did not act in a negligent manner, Young said. “Certainly if the board had known he was capable of an act of violence like (murder), I don’t think thet would have released him in a million years,” he said. A three-member panel ol the parole board had den ied Buntion’s initial request for parole in June 1989 But on May 15, 1990, it gave him $200, a new suitoi clothes and freed him. Buntion was supposed to report immediately to the Texas House, a 300-bed Houston facility for parolees He didn’t. On June 27, 1990, six weeks after he gotoui of the penitentiary, Buntion was riding in a car with a friend when Irby pulled them over. While he talked to the driver, Buntion got out of the car and fatally shot Irby.
