Supreme Court lets convicted Dallas man change guilty plea Battalion IClassifiedi 845-2611 WASHINGTON (AP) — The Su preme Court let stand a ruling that a Texas man once convicted of co caine trafficking is entitled to change his 1987 guilty plea. The court, without comment, re fused Monday to hear Justice De partment arguments that a judge’s failure to inform the man of the charges he faced amounted to “harmless error.” Mario Bernal was arrested in Dal las two years ago as he was selling a kilogram of cocaine, priced at $30,000, to an undercover agent of the federal Drug Enforcement Ad ministration. Bernal initially pleaded innocent to cocaine-related charges but later entered a plea bargain agreement under which he pleaded guilty to one of the charges. In the appeal acted on today, gov ernment lawyers emphasized a part of the same federal rule that says, “Any variance from the procedure required . . . which does not affect substantial rights shall be disre-l garded.” The 5th Circuit court had said! that part of the rule “is designed n forgive inadequate addresses (b judges), not entire failures” to dis-j cuss with a defendant the nature off the charges against him. But other federal appeals courts I have ruled that such failures b) | judges may be harmless error. “The record of (Bernal’s) plea proceeding establishes beyond a I shadow of a doubt that he under- stood the offense to which he was j pleading guilty,” Justice Department I lawyers said.
