But the father of the severely re tarded, blind man blames attack on the Texas Department of Mental Health and Mental Retardation, say ing the agency has failed to provide proper services to cure their son’s vi olent behavior. State officials, however, say they have done all the Lelsz family has al lowed them to do for their son. John Lelsz Sr., 65, said he and his wife, Ruth, 59, had picked up their son from the Richmond State School in Austin and drove him home to Galveston for the week while author ities refurbished his ward in prepa ration for a federal inspection. But when the Lelszes tried to take their son to the grocery store Satur day night, he began hitting and bit ing the couple. “He just freaked out,” the elder Lelsz, who was driving, said. “He wouldn’t believe that we weren’t tak ing him back to that place. He kept begging. He said, ‘Stay at home, stay at home.’ He was flailing his arms and waving. He was completely ber serk.” Lelszjr. bit his father’s arm and hand multiple times, causing him to lose control of the car. He also bit his mother’s shoulder, arms, hands, and finger so severely that she has hail surgery twice since Saturday. A nurse who asked not to be iden tified told the Associated Press the couple are recovering from their in juries at John Sealy Hospital, but probably will remain there about a week. “Both are doing fine, hut they’ve got some infections and all,” the nurse said, adding doctors had de termined they would not have to am putate Mrs. Lelsz’ left pinkie as origi nally believed. The elder Lelsz suffered severe bites on two fingers and his arm, while Mrs. Lelsz had a large gash on the hack of her hand, bites on her left arm and shoulder and many bruises, the nurse said. “Every bit of this was avoidable,’ Lelsz Sr. told the Austin American- Statesman Wednesday. “They (stale officials) have ignored our pleas, They have ignored the court order to get started witli appropriate pro grams for everyone.” John Lelsz Jr. became the lead plaintiff of a 1974 class-action suit seeking state reforms for thecareof the mentally retarded. But Jay Ion Fincannon, depun MHMR commissioner for retarda tion services, said, “To say that this incident or many other (biting) inci dents that have occurred was avoida ble is not quite accurate. “It’s almost impossible to knowif there was something we could have done that would have eliminated John’s aggressive behavior and that therefore, this incident wouldni have occurred. We have done liter ally hundreds of things withjohnjr. in an attempt to curb his aggressive behavior.” “H e’s gotten more services than anyone else has,” said Pat Craig, an MHMR assistant deputy commis sioner. “If anything, we’ve been dis criminatory” toward Lelsz Jr., he said, because his case is difficult and he is the named plaintiff in thedass- action suit. Settlement agreements in the 15- year federal court case don’t include provisions written specifically for Lelszjr. Rather, court orders issued by U.S. District Judge Barefoot Sanders of Dallas require improved services for all retarded people. Information is taken from a food-service estab lishment inspection report. SCORED BETWEEN 90 AND 95: Wings N Things at 1045 Texas Ave. was inspected by David Plett Score — 93. Five points were de ducted because food wasn’t stored at the correct temperature. Two points were deducted be cause some food was improperly thawed. Two points were de ducted because food wasn’t pro tected correctly during storage. One point was deducted because single-service articles weren’t stored properly. Three two-point viola tions were cited because food wasn’t protected properly during storage, food-contact surfaces of equipment weren’t clean and soap was missing at handsinks. Four two-point violations were cited because food was stored in correctly, food-contact surfaces of equipment weren’t clean, tra- shcans weren’t covered and soap was missing from a restroom. Points were deducted in other mi nor areas. David Jefferson, a registered sanitarian at the department, says restaurants with scores ot 95 or above generally have excellent oper ations and facilities. He says restaurants with scores in the 70s or low 80s usually have serious violations in the health report. Scores can he misleading, Jefferson says, because restaurants can get the same score by having several minor violations or a few major violations. He says the minor violations can be corrected during the inspection. Point deductions or violations in the report range from one point (minor violations) to live points (major violations). Jefferson says the department might close a restaurant if: the score is below 60, the personnel have infectious diseases, the restau rant lacks adequate refrigeration, there is a sewage backup in the building or the restaurant has a complete lack of sanitization for the food equipment. The department inspects each restaurant every six months. Jef ferson says a follow-up inspection is sometimes required if a restau rant has a four- or five-point violation that cannot be corrected dur ing the inspection, or if there are numerous small violations.
