Judge: State must keep responsibility for inmates AUSTIN (AP) — It’s the responsibility of Texas prison officials to house their own inmates, many of whom currently are being confined in county jails, a judge said Tuesday. State District Judge Joseph Hart of Austin said the state has “a mandatory, nondiscretionary legal duty to take the inmates in question.” His ruling came in a case brought against the state by Nueces County officials, who want the state to take their inmates into the Texas Department of Correc tions. Hart, in a letter to Assistant Attorney General Rob ert Ozer and Nueces County Attorney Carlos Valdez, denied the state’s motion for a ruling in its favor. However, the judge noted, state officials have ar gued “that it would be impossible to perform what (Nueces County) has requested.” Hart said he wouldn’t issue an order “to compel an impossible act.” The judge declined to elaborate in an inter view. Reggie Bashur, press secretary for Gov. Bill Clem ents, said Hart’s letter emphasizes the urgent needle build more prison space. Clements and legislative leaders Tuesday unveileda $300 million-plus plan to build 10,800 new prison beds. The TDC, now under a federal court-ini posed pop ulation ceiling because of overcrowding, limits the number of admissions with a quota system for count ies. Elna Christopher, spokesman for the Texas attorney general, said it is impossible for the state to take the prisoners from Nueces County. “We run the risk of the federal courts coming bad in on (the prison case) and finding us in violation and fining us, possibly as much as $800,000 a day, which Texas can ill afford,” Christopher said. Hart said there might be ways to take the prisoners without violating the 95 percent population cap im posed by the federal court. He said that should be con sidered, along with other factors. “The issue that remains to try, and that we will try,is whether or not it is impossible to take these prisoners," Christopher said. She said she did not know when a trial might start. Teens rally in support of teaching abstinence AUSTIN (AP) — About 100 teen agers rallied Tuesday in support of legislation that would make teaching sexual abstinence part of any public school course on sex education and requiring minors to gain parental consent before getting an abortion. Carrying a sign “Texas Teens Speak Out,” the high school students cheered in the State Capitol rotunda Sen. Ken Armbrister, D-Victoria and Dan Shelley, R-Crosby, who have proposed the bills. “Young people do support the right way,” Armbrister said. “Whether it be saying no to drugs or saying no to other pressures that are part of your peer group, I pledge my support to you,” he said. Armbrister’s bill would require that abstinence be taught in sex edu cation classes as the most effective way to prevent pregnancy, AIDS and other sexually transmitted dis eases. The bill is pending in a subco- mittee of the Senate Education Com mittee. Several teen-agers spoke at the rally in favor of Armbrister’s bill, saying that sex education was the cause of the high rate of pregnancy among teen-agers. “We didn’t have trouble with teen sex and abortion until we started tea ching promiscuous sex,” Heather Hotrum, 16, a student at Town East Christian School in San Antonio, said. “We need to teach abstinence.” Katrina Gonzalez, 17, of Taft High School, said, “I think that absti nence should be taught. If it’s taught I know that all abortions will stop, sexually transmitted diseases will stop ... and we’re just going to have a world that is just going to be so great.” John Kearns, 16, also a student at Town East, said, “I’m really upset that all legislators think that all teens are promiscuous. I’m 16 years old and I’ve never had sex and I plan to wait until I’m married.” Children need guidelines on sex ual abstinence, said Marlene S. Mc- Michael, legislative liaison for the Concerned Women for America of Texas. Reverend asks government to support poor AUSTIN (AP) — The Rev. W.N. Otwell, who has fought the state for years over his homes for troubled youth, blasted state gov ernment in general Tuesday for treatment of the homeless and said the poor should be given free driver’s licenses, license plates and basic auto insurance. “It’s time the Legislature got their head out of the sand,” Ot well said during a chilly rain at a rally outside the Capitol. Otwell, pastor of the Church at Fort Worth, who has said he is seeking the Republican Party's nomination for governor, was flanked during the rally by about 35 homeless people carrying signs saying, “I am a political cas ualty of the streets,” and “Big Brother government put me on the streets.” Otwell said bureaucratic red tape and taxes are putting thou sands of Texans out on the street.
