Supreme Court allows Texas to argue claim for lost money AUSTIN (AP) — The U.S. Supreme Court on Tues day gave Texas the OK to argue its case over unclaimed money taken by New York, a battle Texas officials said could mean tens of millions of dollars for the state. “We will have the possibility to litigate over hundreds of millions of dollars,” said Attorney General Jim Mat tox. “We don’t know how much exactly, but there’s more than one pot of money we’re seeking access to. It could be a very large amount.” The Supreme Court allowed Texas to intervene in a multimillion-dollar battle between Delaware and New York over unclaimed dividend and interest payments on securities such as stocks and bonds. At issue are payments that have no known owner. That money is being held by brokerage firms in New York, and the state of New York gets the unclaimed funds after three years. Delaware argues that New York shouldn’t be allowed to collect the funds because most brokerage houses are incorporated in Delaware. Texas argues that unclaimed interest and dividend payments originating from companies or government bodies located in Texas should be paid to Texas. “This money, which rightfully belongs to Texas, has been held by the state of New York,” Treasurer Ann Richards said. “It is our position that the only known factor in lit whole transaction or series of transactions is wheretk money originated,” she said. The Supreme Court on Tuesday granted Mattox's request to intervene. Justices last May agreed to settle the dispute without it first having been heard in some lower court because the case is one between states, Mat tox said. Every year, brokerage firms recover up to $2 r each in dividend and interest payments for peoplewk cannot be located. All states have so-called “escheat” laws which providt that such abandoned money goes into the state treasttr after remaining unclaimed for a specified period of time. “We are saying that — where we cannot determiot the exact address of the real beneficiary of that mono — it ought to go to the home state of the corporatk that originally issued either the stock or the bonds Mattox said. The lawsuit involves money collected by New Yotl over the last 10 years. Richards said that the Supremt Court’s decision also will give T-t^as officials accesst New York’s unclaimed property-files, something Net York officials have refused to allow in the past. Mattox said he is optimistic about the Texas case. Arbitrator rules for reinstatement of policeman accused of misconduct HOUSTON (AP) — In an admit tedly ambivalent ruling, an arbitra tor ordered the reinstatement, with out back pay, of a Houston police officer fired for allegedly fondling a woman he pulled over in northeast Houston. The ruling angered Police Chief Lee P. Brown, who has had a num ber of his firings overturned by arbi trators recently. He called for abo lishment of the arbitration system for city employees. Officer Ernest R. Cooper was fired last April after a woman charged he followed her July 26, 1987, from the central police station, where her husband was in custody, and fondled her while promising to help get her husband released from jail. In granting Cooper’s reinstate ment, arbitrator Walter D. McCoy wrote, “It is important to point out that while the indefinite suspension will be rescinded, the arbitrator is not fully convinced that the total be havior of (Cooper) was within the scope of good conduct and I do not feel that such behavior should be viewed with impunity.” However, McCoy wrote, Cooper’s firing “was not based on just ancl suf ficient cause,” and that his grievance “is upheld in part and denied in part.” The disciplinary action was or dered stricken from Cooper’s per sonnel records. Cooper allegedly stopped the woman for driving with her head lights on high-beam. She com plained that the officer tookherio his patrol car and questioned searched her, fondling her. Police computer records con firmed that Cooper stopped woman and placed her in his car However, he denied putting h hands on her in any way, The woman later presented inves tigators a telephone number she said the officer gave her with instruction to call him the next day. The num ber was traced to Cooper’s home according to arbitration documents. McCoy said the woman’s com plaint might have been motivated!)) anger at police for jailing her hus band.
