Two of the suits were filed against Bernard Levine, owner of the three- level department store, and his com pany, Los Amigos Inc. A third suit named the company and the store’s builders, Adams Brothers General Contractors Inc. Calls to Levine’s home were not answered Monday. Two of the lawsuits were filed by Tuan Lopez-Butron of Matamoros, State officials break ground for new prison GATESVILLE (AP) — State offi cials turned symbolic shovels of soil Monday near the construction site of a. new maximum security prison and called for more like it. “We have simply got to have the facilities,” said Board of Corrections chairman Charles Terrell, referring to what he called the “ridiculous early release system” now in use to ease prison crowding. “It doesn’t do any good to have rehabilitation pro grams ... if you don’t have the pop ulation long enough to do some thing about it. Prison board members, legis lators, and local officials gathered in a prison gym for a ceremony mark ing the symbolic start of construction of a 2,250-inmate penitentiary to be built near the existing prisons in Coryell county. The $60 million Alfred D. Hughes Unit, named for a former prison board chairman, should be completed by October 1989. A similar maximum security prison will be built near Amarillo. Both sites were selected last year by the prison board. The prisons will be paid for by bonds approved last No vember by Texas voters. Mexico, whose wife, Graciela Corti- nas de Lopez, was the fifth victim pulled from the rubble. Lopez-Butron accused Amigo Store of failing to warn his wife a col lapse could occur and failing to properly inspect the roof and its drainage system. He also accused Adams Brothers of failing to install a safe roof, failing to inspect it and failing to properly install an adequate way to drain the flat surface. In that suit he requests a trial by jury and asks for no more than $5 million in damages, interest and court costs. Luis Enrique Cortinas Villarreal filed a suit seeking damages for the death of his mother, Marisela Villar real Vda. de Rivera. He names Le vine, the store and Levine’s company and alleges negligence. William B. Ha rrison of Corpus Christi represents Villarreal and Lo pez-Butron. Allen Moore o( Brownsville represents L.opez-Bu iron in the suit that names the store and the construction company. Meanwhile, heavier than usual traffic ilowed through the down town street where the building col lapsed, with passersby slowing to look at the floor — all that remains of the structure. Senator says tax firm unethical with contract SAN ANTONIO (AP) — A representative of attorney Oliver Heard Jr. offered state Sen. Frank Tejeda between $10,000 and $80,000 to help wrest a local school district’s delinquent-tax collection contract from a rival firm, according to a published re port. Tejeda secretly recorded two conversations with Lupe Zamar- ripa, a representative of Heard’s firm, the San Antonio Light re ported in a copyright story. The story said the tapes were re corded in Tejeda’s southside dis trict office. On the tapes, Zamarripa pro posed that Tejeda become the firm’s liaison in the school district to help convince area officials to award the contract to Heard's firm, the newspaper reported. Tejeda rejected the offer be cause it had a “foul odor” and smacked of influence peddling, he said. Heard said Sunday he w'as not aware of any impropriety and de manded access to the tapes. “I demand that Senator Tejeda make the tapes available to me," Heard said. “I’d like to read them in their entire context. I’m not going to respond anymore until I have a chance to see it (the tran script).” T ejeda said he plans to provide H card with a copy of the record- ings. In the tapes of meetings May 18 and June 15, Zamarripa said Tejeda could earn additional money by securing other con tracts in San Antonio districts where the senator’s influence with school board members is strong, the newspaper reported. “Let me tell you this, Frank,” Zamarripa said. “You’ve got a lot of contacts in San Antonio and a lot of contacts around the stale. “There’s a lot of possibilities; you can make a lot of money.” Zamarripa told Tejeda he could earn the $10,000 to $80,000 as a percentage of back tax receipts if he steered theHar- landale School District’s delin quent tax contract to Heard from the school attorney. North West, who currently has the contract. The payments would continue annually as long as Heard’s firm held the c ontract, Zamarripa said. Heard, the senior partner in the San Antonio law firm of Heard, Coggan, Blair & Williams, said he only learned of what he called the “misunderstanding” between Tejeda and Zamarripa on Friday.
