WATER MELON PINA COLADA (MANY MORE) LOCATED AT NORTHGATE NEXT TO UNIVERSITY BOOKSTORE Protest Doctors limit surgery in response to 'inadequate' malpractice laws Associated Press ALBANY, N.Y. — Dozens of up state doctors, angry over what they feel is an inadequate reform of mal practice insurance laws, sharply lim ited surgery Monday and told mal practice lawyers to “find another pigeon.” The protest over rising insurance rates coincided with the First day of a more-than-50 percent insurance premium hike that was approved by the state Insurance Commissioner. In an eight-county area of western New York, medical officials made provisions to send severe surgical cases to neighboring states and Can ada. In Syracuse, just eight of 40 or thopedic surgeons were operating. At the State University Hospital’s Upstate Medical Center there, a cof fee shop and a clinic were converted to deal with an anticipated overflow of patients turned away from doc tors’ offices and private hospitals. “I warn you, Find another pi geon,” Dr. Thomas A. Lombardo of the Erie County Medical Society said of malpractice lawyers Sunday in an address to a doctors’ meeting in Buf falo. “Your incredible greed has killed the golden goose. The egg is no longer going to be there. You’ve awakened a sleeping giant.” Some doctors had been slowing down their work over the past two months, leading to layoffs at at least one hospital. Their protests intensified even af ter the state Legislature passed a law over the weekend that is designed to stem the rise of malpractice premi ums. The law, which awaits Gov. Mario Cuomo’s signature, was deemed in adequate by many in the medical profession. “In 1961, I paid $2()()" in insur ance premiums, said Dr. David Dean, a Buffalo cardiologist. “Now, I’m up to $10,000, and that pre mium is small compared to a neuro surgeon.” The doctors’ loudest complaint centers on their inability to get a $1 million cap on personal liability and $250,000 cap on pain and suffering awards. The New York State Bar Associa tion “is pleased that proposals to cap pain and suffering and create a re strictive form of arbitration” were omitted from the legislation, said bar president Justin L. Vigdor.
