Onion said before Wednesday’s court session that he was informed Tuesday by Hayes’ attorney, Dave Rogers, thht Kim Hayes was about to undergo an abortion. After a brief session Wednesday, Onion transferred the case to Curry, who dissolved the order. “I can’t see how I have the right to prevent this lady from having an abortion,” Curry said. The case was a showdown be tween anti-abortion activists, includ ing Hayes, and pro-choice groups, who claim Mrs. Hayes has a constitu tional right to abort the pregnancy. “It’s my child as well,” Hayes said at Wednesday’s hearing. “The baby should not be killed because she wants to get even. My baby is going to suffer for what she feels is just re venge.” Hayes said he did not believe in abortion and would be willing to pay Mrs. Hayes’ medical expenses and rear the child. “She said it was her baby and there was nothing I could do to pre vent it (an abortion),” he said. Hayes and his estranged wife, according to a petition filed last week, married Oct. 16, 1984. The document claims the woman became pregnant shortly thereafter. The couple separated Jan. 28 ie woman told her husband of and the woman told her husband of her plans to abort the pregnancy, according to the petition.
