The jury last week convicted Fucker, 24, of capital murder and was hearing testimony to determine if she should be sen tenced to death or life in prison. Tucker, who did not testify in Stay is denied for killer United Press International SAN ANTONIO — A fed eral judge Tuesday rejected a stay of execution for convicted killer Jesse De La Rosa, who is scheduled to die Friday for the murder of an Iranian store clerk. U.S. Judge H.F. “Hippo” Garcia denied the stay without comment, clearing the way for De La Rosa to be executed by a lethal injection. De La Rosa was sentenced to die for the Aug. 22, 1979, murder of store clerk Masoud Ghazali, 27, a former Iranian Air Force officer who was shot in the head in a robbery that netted only a six-pack of beer. Defense attorney Rusty Guyer said he would file an other appeal with the 5th U.S. Circuit Court of Appeals. “I’m just going to keep plug ging away,” he said. “Everyone is relying on someone else to stay the execution. We’ve got good issues. We’ve got a good reason for a new trial. I hope it (execution) will be stalled for a while.” The Texas Court of Criminal Appeals Monday denied a stay of execution based on Guyer’s claims of jury misconduct at De La Rosa’s trial in San Antonio. Guyer also maintains that De La Rosa confessed to the crime under intense police question ing in which, he said, officers threatened the suspect’s family with jail. Bexar County prosecutor Dick Ryman, who handled De La Rosa’s original trial, called the crime “a cold-blooded exe cution-style killing.” Ryman said that De La Rosa, her trial, said she hit Jerry Lynn Dean, 26, after he had been hit in the head with a hammer by co-defendant Daniel Garrett. Garrett has not been tried yet. “All I wanted to do was stop him from making that noise,” she said. “I saw a pickax against the wall.I reached over and grabbed it and swang it and hit him in the back for or five times but the sound didn’t stop.” She denied trial testimony that she smiled while striking Dean and said tape recorded comments that she felt sexually aroused by the blows were false. She said she exaggerated to her sisters and friends portions of the crime to impress them. “1 wanted to fit in the group I was with,” she said. “I felt I needed to live up to their stan dards and I exaggerated it quite a bit. I just want to be as cold and mean as they were.” She also admitted hitting a woman with the pickax. She and Garrett have both been charged in the death of Debra Ruth Davis Thornton, 32. Tucker said that in both cases, Garrett struck the final blows to the victims. Defense attorney Mack Ar nold, who last week stunned the court by asking for a verdict of guilty against his client, said having Tucker testify was the only “chance in the world to save her life.” “I don’t think they under- ther testified earlier Tuesday that she had found God while in jail and was a different person now.
