OVER SO AEROBIC CLASSES WKLY Braniff one step closer to returning United Press International WASHINGTON — The Civil Aeronautics Board said Thursday Braniff Inc. is fit to fly, a decision the newly reorga nized carrier’s attorney called a “very big and very happy step” toward its scheduled March 1 return to the skies. The five-member CAB is sued a memorandum saying it had declined to review Admin istrative Law Judge John Vit- tone’s decision approving Bra- niffs fitness application. The decision allows the transfer of a fitness certificate from bankrupt Dallas-based Braniff Airways Inc. to Braniff Inc., owned by the Chicago- based Hyatt Air Corp. under a firm known as Dalfort Corp. “This was a very big and very happy step for us,” said Tom McGrew, Braniffs Wash ington attorney. “If it hadn’t been handled as expeditiously, it could have held up our plans to fly by March 1.” The CAB fitness review certified that the new airline is economically fit to operate. McGrew said the airline now needs only to receive a Federal Aviation Administra tion operating certificate ap proving Braniffs equipment and FAA approval of proposed operating specifications. “Everyone I’ve talked to is confident that can be done to get in the air by March 1,” said McGrew. He praised both federal agencies for moving so quickly on Braniffs application to fly. The CAB acted within 65 days on the fitness application when the usual amount of time needed is six months. Braniff International filed for bankruptcy in May 1982 and has been struggling since then to become airborne again. Vittone ruled Tuesday that Braniff is fit to engage in interstate anti overseas air transportation of passengers, cargo and mail but the ruling was not publicly announced be cause it is considered an initial decision. Vittone said Braniff can fly to all points in the United States, its territories and posses sions. Vittone issued the decision without holding the usual oral arguments after granting confi dential status to some of the items Braniff presented.
