Court officials said closing arguments were slated for 2 p.m. Tuesday. They had been scheduled for 10 p.m. Tuesday after being delayed both Friday and Monday because jury in structions were not completed. Testimony indicated Grand staff, a camp foreman, was shot once in the back when he went to help the officers. Grandstaffs widow, Sharon, filed the suit against the city of Borger, the counties of Hutchinson, Carson and Gray, and five of six officers present at the time of the shooting. One of the officers is a Hutch inson County deputy and the rest are current or past Borger policemen, court records showed. Federal court officials said pending motions included re quests from each of the defen dants for a directed verdict ac quitting them. Those motions were filed upon completion of testimony last week in the 3- week-old trial. All motions from attorneys for the three Panhandle coun ties said Texas law makes coun ties and municipalities immune from legal action stemming from negligent actions of their employees. Amarillo attorney Wayne Sturdivant filed the motion for the city of Borger, saying the city should not be held liable because Burger’s police policy was not responsible for the shooting. “Without admitting, and de nying always, that it was a bullet fired by a member of the Borger Police Department which pro duced the death, the defendant would respectfully direct the court’s attention to the fact that the evidence in this case is with out dispute that the death came about by reason of a mistaken identity,” Sturdivant wrote.
