The decision affirmed a U.S. Court of Claims ruling that found the government owes money to members of the Quinault Reservation in the state of Washington. The Quinaults claimed the Interior Department caused “pervasive waste and misman agement” of tribal timber lands, and owed them for lost revenues and property devaluation. Writing for the majority, Jus tice Thurgood Marshall con cluded that federal laws “clearly establish . . . obligations of the government in the management and operation of Indian lands and resources.” The laws, Marshall found, “can fairly be interpreted as mandating compensation by the federal government for dam ages sustained.” Dissenting, Justice Lewis Powell contended the court ma jority misintrepreted what Con gress meant in writing the laws. There is no indication, he said, “that Congress intended to consent to damages actions (against the government) for mismanagement of Indian assets by enacting these provi sions.” Joining Powell in dissent were Justices William Rehnquist and Sandra Day O’Connor.
