juries may award damages for
mental anguish in the death of a
child.
In a 6-3 ruling, the high court
said the current law that allows
damages only for the economic
loss of a child is “based on an
antiquated concept of the child
as an economic asset."
“If the rule is literally fol
lowed, the average child would
have a negative worth," wrote
Justice Franklin Spears. “The
real loss sustained by a parent is
not the loss of any financial be
nefit to be gained from the child,
but is the loss of love, advice,
comfort, companionship and
society.”
