Brad M. Spencer, 23, whose father owns Hunter-Bradley Co. of Dallas, said he sold a Wetherby Mark V .240-caliber rifle, Leupold scope and two boxes of .240 ammunition on May 17, 1979, to a woman who identified herself as Fay L. King. Jo Ann Starr Harrelson, the wife of convicted hit man Charles V. Harrelson, has been convicted of using the alias Fay L. King to buy the rifle. Chagra, 39, a high-stakes gambler, under indictment in 1979 for smuggling narcotics, is accused of paying Harrelson $250,000 to kill U.S. District Judge John H. Wood Jr. Wood, who was scheduled to preside at Chagra’s narcotics trial, was shot in the back with a bullet from a high-powered rifle on May 29, 1979, as he left his San Antonio townhouse for work. The trial of Chagra was moved to Jacksonville because of extensive pre-trial publicity in Texas. Under cross-examination Tuesday by Chagra’s attorney, Oscar Goodman of Las Vegas, Nev., Spencer acknowledged he lied to the FBI agent who inter viewed him Aug. 6, 1981, when he said he had seen federally re quired identification from the woman calling herself Fay L. King. “There was one time when I sold a gun to a lady without a driver’s license. This could have been that time,” Spencer con ceded. “ I was more worried ab out what my dad would do if he found out that I had not fol lowed the customary proce dures.” He said the woman came into the Dallas store and said she was looking for a rifle for her hus band. When asked for a driver’s license at the time of purchase, she said she didn’t have it with her. Since she lived in Greenvil le, she asked if she could get the number by phone, Spencer said. “I allowed her to make the phone call and get the driver’s license number for the Form 4473 (U.S. Bureau of Alcohol, Tobacco and Firearms), ” he said. Spencer was one of a parade of government witnesses Tues day that included three FBI agents, four motel employees, a telephone company record- keeper, a former assistant U.S. attorney, a cartographer and a parking lot attendant. The witnesses identified such government documentary evi dence as motel registration cards, folios and charges, tele phone bills, the Form 4473 and sales receipt for the gun, a park ing lot “audit” at the Midland, airport and a 1979 map of Las Vegas, where Chagra lived.
