I The council agreed die gas flares needed to lie eliminated but questioned whether pipe lines are the solution. The councilmen expressed concerned about possible dam age to public and private prop erty during pipeline construc tion. But die ordinance specific ally states that the pipeline com pany who installs the lines must restore city property to its pre vious condition. If a company doesn’t restore the land to its previous condi tion, the company will receive a bill for restoration work which will include a penalty of 25 per cent of the restoration costs. Some council members ex pressed concern that if thev approved the use of citv land for pipelines, pipeline companies might ignore the restoration of private citizens' land when used for pipelines. Officials from three pipeline companies said lease agree ments with individuals mav solve potential problems with re storation of private property. Councilman Henry Seale said he also was concerned about pipeline companies’ right to have private property conde mned in order to lay pipelines in the area. But Mayor Richard Smith said the right to condemn pri vate property — eminent do main — is a right the state grants to public utilities companies or companies who are common carriers for some item, such as gas and oil. So the citv of Brvan has no control over whether the pipeline Companies can force private landowners to allow a pipeline to be built. T he ordinance also states that the city of Bryan cannot lie held responsible for anv citizens’ claims for damages caused bv the company's equipment and pipeline construction. The council didn't vote on the ordinance because each com pany which requests permission to lay a pipeline must submit a plan and get the approval of the council before any construction^ can take place. If an ordinance for a particular company is approved, the agreement is in effect for live years. Smith said many of the ques tions raised about the ordinance will he considered in each indi vidual company request for per mission to lav pipelines.
