ON — The Sup reme Court agreed Monday to weigh a dispute raised by the Three Mile Island nuclear acci dent to determine whether “psychological stress” on neigh bors should be evaluated before restarting an undamaged unit. Next year justices will review a ruling that for the first time would make the Nuclear Reg ulatory Commission consider psychological effects before per mitting a nuclear plant to op erate. The nation’s worst nuclear accident at the plant in Middle- town, Pa., crippled TMI’s No. 2 unit in March 1979, spreading radiation and spurring a tem porary evacuation of pregnant women and preschool children within a five-mile radius of the plant. Its twin reactor, No. 1, was not damaged, but has been in cold shutdown ever since. General Public Utilities, the plant’s owner, is seeking permis sion to restart the No. 1 unit, but has encountered strong com munity opposition. One group, People Against Nuclear Energy, claim residents would suffer “severe psycholo gical stress” if the undamaged unit is restarted. It claims the accident created intense anxiety, tension, and fear among residents, accompa nied by physical disorders such as skin rashes, aggravated ulcers and skeletal and muscular prob lems. The NRC at first refused to consider the residents’ com plaints of mental distress. But the U.S. Circuit Court of ai Appeals in Washington ru otherwise. The appeals court ruled t the National Environmenlalj Policy Act requires the NRCtoj look not only at effects on pM sical health, but also on “psychol logical health,” including “p traumatic anxieties caused b)| fears of recurring catastrophe,'! Reaction to the ruling ivasj fierce. Judge Malcolm Wilke]] dissented from the decision and j warned it could result in “coujl imposed paralysis of niidearl power.” On appeal to the Supreme I Court, the government’s lawyers complained the ruling wrongly, turns an environmentallawinio one that deals with human emo-1 tions. In a separate appeal, TIM owner contended the ruling|l only could block the restartofils [ reactor, but also could let public fears about nuclear energy stand in the way of nuclear plain licenses across the country. The secretary said even if Democrats fare well in the con gressional elections today, the administration will not change its basic economic programs. “I think our economic pi cies are correct,” Regan said, But, Regan said something has to be done with Social Secun ity because more money is going out to beneficiaries than is com* ing in from Social Security taxes. He offered no specific sugges ; tions on how to deal with the imbalance. Democrats have accused. President Reagan of planningto slash Social Security benefits af ter the election. The president! has denied any such plans,; saying he would protect the So cial Security program for those who depend on it.
