Any student wishing to withhold this information should fill out, in person, the appropriate form, available to all students at the Re gistrar’s Office, no later than 5 p.m., Tuesday, September 14, 1982, United Press International TRENTON, NJ. — A super ior court judge revoked the bail for 565-pound rapist Joseph “Jo Jo” Giorcianni Wednesday and ordered him back to jail to serve a 15-year sentence lifted earlier for health reasons. “The defendant’s health E roblems have not prevented im from engaging in normal activities,” Judge Richard Bar- low Jr. said at the 2-day hearing called to reconsider the obese sex olfender’s sentence reduc tion. Giorgianni was ordered to begin serving his sentence im mediately. Barlow listened to closing arguments from county pro secutor Phillip Carchman who cited testimony and argued Giorgianni should be jailed be cause on the brutal nature of the crime. Giorgianni was convicted in 1980 of raping a girl, 14, behind his steak house. “This defendant may die if he goes to jail,” Giorgianni’s attor ney E. John Wherry told Barlow after the sentence was rein stated. Wherry said an appeal would be filed within 24 hours. Giorgianni arrived at the courthouse at 7:30 a.m. and waited in a room on the fifth floor for the hearing to begin. He walked up the courthouse steps alone, after being dropped off by a woman in a black Lin coln Continental. Giorgianni, who wore a white short sleeve shirt and brown polyester pants, sat on a special double wooden bench as Barlow delivered his decision before a packed courtroom. Barlow ordered Giorgianni released Aug. 6 after he had served less than a week of the 15-year sentence. He based his ruling on medical testimony that incarceration would be life- threatening to Giorgianni be cause of the lack of air condi tioning and other facilities in jail. During Tuesday’s hearing, Carchman introduced a videotape of the sex offender at a June boxing match to back up his claim that Girogianni was healthy enough to be jailed im mediately. William Masselli is co-owner of Jo-Pel, a Bronx construction company that did business with ochiavone Construction Co. of New Jersey, where Donovan was an executive before assuming his Cabinet post. Silverman’s June 28 report on the charges against Donovan disclosed Nat Masselli allowed the special prosecutor’s investi gators to tape four telephone conversations he had last May with Morris Levin, a lawyer for Schiavone. Two federal law enforcement officials familiar with Silver man’s investigation privately have criticized the special pro secutor for publicly disclosing Nat Masselli’s willingness to per mit the recordings.
