Fair Condition. 170t4 United Press International DALLAS — A probate judge says he will appoint two psychiatrists not employed by the Texas Department of Men tal Health and Mental Retarda tion to evaluate a man released recently from jail even though he had confessed to killing a fel low patient at the Terrell State Hospital. Judge Joseph E. Ashmore Monday ordered Christopher C. Nalley, 20, transferred f rom the Hillside Mental Diagnostic Center in Dallas back to Terrell State Hospital. The judge signed an order putting Nalley under protective custody for up to 14 days. “He’s there because we want to be sure of what his present mental status is,” Ashmore said. “If he needs to be in a mental hospital, that is where he should be.” Nalley was released from jail July 1 after stat^ District Judge Richard Davis of Kaufman County ruled police had illegally obtained his confession in the 1978 slaying for a Grand Prairie boy, 13, who was a patient with Nalley at Terrell.
