In withdrawing the disputed rules, the department said a work ing group was being set to draft an alternative proposal to “strike an equitable balance between con flicting concerns while removing uncertainties.” The defunct rules, proposed as part of federal coastal zone man agement regulations, would have prevented the states from inter fering in the early stages of the federal offshore leasing process. California, which filed suit against the rule when the govern ment first proposed it in May, re cently won a favorable decision from a federal court. “I think the immediate effect of our withdrawing the regulations will probably not be significant,” Brian Gorman, department spokesman said. “The general feeling is there would be litigation no matter what happened.” The House Merchant Marine Committee posed a more immedi ate problem when it voted 20-15 in favor of a resolution that would nullify the rule. The Senate Com merce Committee was poised to take similar action. Intense administration lob bying failed to derail the House resolution, offered by Reps. Gerry Studs, D-Mass., and Joel Pritch ard, R-Wash., who represent states concerned about the effect of the regulations on their states’ coastal zone management plans. Twenty-six coastal states have such federally approved environ mental plans, which gave them legal grounds under the 1972 Coastal Zone Management Act to contest federal offshore leasing that might interfere with their efforts. The 1972 law requires that fed eral activities that have an impact on the coastal areas, such as oil drilling, must be consistent with state plans. The defunct rule would have barred state interfer ence until after leasing areas were mapped out in the pre-lease sale stage. “The government argument is there are several steps along the way after the pre-lease sale in which states can object to prop osed leasing,” Gorman said.
