Now the couple who operated as un dercover agents in the case have admitted he was right. Within hours after former un dercover agents Creig Matthews and Kim Ramsey Matthews pleaded guilty in federal court to conspiring to violate Bora’s rights, a state judge voided Bora’s conviction for assaulting Matth ews in 1979. The Matthews were charged with conspiring in 1979 to violate Bora’s civil rights by framing him and lying during his trial — lead ing to his faulty imprisonment. In voiding Bora’s conviction. District Judge Don Carroll said, “There’s a difference between shooting a police oflicer who has filed a case on you and shooting someone who framed you.” The Matthews appeared before U.S. District Judge William Ste- ger, waived grand jury indict ments and pleaded guilty to the charges against them. In Washington, the Justice De partment said the couple submitt ed a police report on March 31, 1979 falsely accusing Bora of de livering cocaine to a third party. The complaint said Bora was arrested, indicted and tried twice on false testimony from the cou ple. Bora was convicted last year of “retaliation” in connection with a shotgun attack on Creig Matth ews in 1979. The Matthews face a maximum penalty of 10 years in jail and a $10,000 fine. El Paso wants to drill water wells in the Mesilla Bolson water basin to supplement that city’s future water supplies. Along with the suit, El Paso has submitted a protest against the filing of any water well drilling permits. The protests, along with State Engineer Steve Reynolds’ declaration that the Mesilla Bol- tha son is a closed basin, have real ed in a freeze on new well drillia in southern New Mexico.
