age 10 THE BATTALION WEDNESDAY, APRIL 1, 1981 State Houston TV stations refuse to turn tapes over to judge United Press International LIBERTY — Attorneys for two ouston televison stations said uesday they would not turn over ic unedited versions of Thurs- ly’s newscast depicting Vickie aniel turning over her two young ins to sister-in-law Jean Daniel lurph for a visit with their grand- ^rents. Jim Crowther, representing oh Nicholas and KPRC-TV, gave idge Sam Emison Jr. the edited jrsion of the newscast, but ob- cted to giving the court posses- on of the unedited tape. Crowther said unedited and un- ablished material is privileged id therefore falls under the ffee- om of press rights in the First Amendement. Emison recessed without mak ing a decision and said he will pick the matter up after the hearing is resolved. The hearing to deter mine if Daniel or Murph will get custody of the two boys is in its third week. Nicholas said he would go to jail if necessary to defend the right to withhold the unedited tapes. Also subpoenaed by the court was a report by M. A. Barrera for KTRK-TV. Murph’s attorney, Zeke Zbranek, said he does not feel the First Amendment protects the newscasts because they were “biased, one-sided facts.” He said Murph did not know the reporters would be at the house filming the incident when she pick ed up Franklin Baldwin, 3, and Marion Price IV, 1. In testimony late Monday, a physician contradicted Daniel’s testimony that she and her hus band, former Texas House Speaker Price Daniel Jr., had a violent, physical fight before she shot him. Dr. J.E. Bunce, testifying in the child custody suit filed by Price Daniel’s family, said he examined Daniel after the Jan. 19 fatal shoot ing of her husband. “When I first saw her she was restrained on a stretcher, had been sedated and was crying,” he said. Bunce said he found no indica tions she had been choked. “In examining the neck there was no external injury or muscle tenderness,” he said under ques tioning by Zbranek. Daniel had testified her husband choked her and slapped her repe atedly the night of the slaying, and that she shot him in self-defense. Bunce said Daniel had a bruise on her forehead and “tenderness” | on her left arm but said the injuries likely came during her struggle with ambulance attendants who re strained her and took her, hysteric al, to the hospital. However, under cross- examination by Richard “Race horse” Haynes, one of Daniel’s attorneys, Bunce admitted the head bruise was consistent with a kick. Bunce also contradicted Daniel’s testimony that her husband abused her often before the night of the shooting. Bunce said in the 19 visits she made to his office since 1976 he never saw bruises on her. Daniel was hospitalized four days after the shooting and Bunce said she was too upset to talk until the second day of her stay. Bill Clements said Tuesday he had not increased his own security in the aftermath of the assassination attempt on President Reagan.
