That case now is under appeal in the 10th Circuit Court. In the ruling Thursday, the court said an Oklahoma City federal court judge acted properly in dismissing a civil rights suit against the company and FBI agents. Attorneys for the heirs argued the court lacked juris diction to take such action. In the suit, heirs of Silkwood argued Kerr-McGee officials formed a conspiracy in November 1972 to prevent employees from organizing a labor union. The suit claimed the employees were placed under illegal surveillance, their phones were tap ped and they were followed. The Denver-based appeals court disagreed. “Entrusting the exclusive power of vindicating these constitutional rights to the NLRB, which may re fuse to hear a case at will, raises grave constitutional implications, height ened by the NLRB’s lack of expertise in constitutional matters, a field tradi tionally reserved to the courts,” the appeals court said. "Ruling that the board has exclu sive jurisdiction in this area would give free rein to government officials and private parties acting in concert with them to violate the constitution al rights of others with impunity.” The appeals court also agreed with the lower court judge that the com plaint was insufficient to stand as a class action under the Civil Rights Act. "Here it seems clear from the complaint as a whole that the feud, if there is one, is private,” the court said. "No general prejudice which transcends the immediate dispute is shown. “Rather the hatred which defen dants allegedly harbor is against Karen Silkwood and her associates arising out of the activities of parties involved.
