But school superintendent Ralph Downs said the school board will be waiting anxiously for a U. S. Supreme Court decision expected this fall on whether schools are required to edu cate the children of non-permanent aliens. “We do not feel you should expect public schools to educate your chil dren for free,” said Downs, referring to non-resident aliens. Downs said the school district has always enrolled foreign exchange students and aliens who applied for U.S. citizenship, but has charged tuition to children of foreign stu dents attending local colleges. He said from 25 to 50 students now paying tuition will be affected by the ruling. The boy’s father, Arash Varshosaz, had been told by school officials from an independent school district with in Oklahoma City, that he would have to pay $1,859 in tuition or the child “could no longer remain” in school. District Judge Garmon C. Harris ruled Monday that young Varshosaz can attend the school without paying tuition and without the fear of being expelled. Noting that the case’s outcome could set a precedent for “about a 100 or 1,000” such students, Harris said the child’s father is legally resid ing in the United States and meets the school district’s residency re quirements. Varshosaz, 34, told the court he could not afford to pay tuition costs the school assessed about a week af ter classes began. From school officials’ estimates, the school district may need an addi tional $150,000 — about 6 percent of the school district’s $25 million budget — to subsidize the foreign students’ educations. Oct. 1 Rehearsal 7 p.m. United Press International AUSTIN — The Travis County grand jury Tuesday did not indict former Deputy Comptroller Ralph Wayne on allegations he had used state personnel and equip ment to conduct personal business. The grand jury, the fourth to study allegations against Wayne and Comptroller Bob Bullock since 1978, re turned a “no bill” in the case and District Attorney Ronald Earle said there was insufficient evidence to merit action against Wayne, a former state representa tive from Plainview. “We told the grand jury the case was not legally sufficient,” said Earle, who kept the case alive more than a year awaiting FBI transcripts of tapes from mem ory typewriters that former Comptroller s Department employee Bill Collier said would show Wayne utilized his secretary and the equipment to conduct his private business. “It could not be proven that Ralph Wayne’s use of the memory machine was to secure benefits for himself. He also worked 10 to 20 hours a day and we could not determine how much of that was state business, ” Earle said. Earle said he presented the case to the current grand jury because the investigations of two earlier grand juries had focused on allegations against Bullock, and he had promised to present the allegations against Wayne to another grand jury after he received the typewriter tape transcripts. He said the transcripts showed the typewriter was used for state business, some personal letters, and some personal business letters for Wayne.
