Rulings affect corporation wl justices of peace, trucken United Press International AUSTIN — Attorney General Mark White has issued three sepa rate rulings affecting truckers who haul agricultural products, corpora tions that issue bonds to finance commercial projects and justices of the peace who had insisted that arraignments be in the same courts that issue search warrants. White said Monday the Railroad Commission has authority to set rates for truckers hauling agricultu ral products, despite new legislation relaxing requirements for trucking licenses. “In our opinion, it is your duty to set rates to be charged by persons transporting property under the au thority of a seasonal agricultural license,” White told the state special industrial development cor porations set up under the new law do not need approval of his office for the revenue bonds they issue. In a third ruling, White said that a justice of the peace cannot require police to return suspected criminals to his court for arraignment, even though he issued the search warrant that led to an arrest. Commission Chairman John Poer- ner asked White for a legal ruling on the rate setting authority of the state agency under the new law passed by the 1979 Legislature exempting haulers of farm products from some of the stringent requirements for a state trucking permit. White said the commission can set minimum or maximum rates or both. In a separate ruling, White upheld the constitutionality of a new law au thorizing public corporations to issue bonds to finance or refinance projects to be leased or sold to com mercial, manufacturing or industrial enterprises. White said the plan does not violate provisions of the Texas Con stitution prohibiting lending public credit or money to any private indi vidual, association or corporation. The governors unanimously approved a resolution by Gov. James A. Rhodes of Ohio favoring con tinued regulation of the trucking in dustry. Minutes later, the governors adopted a resolution calling for de regulation of oil and gas prices and criticizing bureaucratic regulatory barriers in that industry.
