Page 8 THE BATTALION THURSDAY, OCTOBER 25, 1979 Priest seeks friend’s euthanasia United Press International MINEOLA, N.Y.— A Roman Catholic priest is seeking to have an 83-year-old fellow clergyman re moved from a life-sustaining re spirator because “his soul has fled his body.” The Rev. Philip K. Eichner, pres ident of the Roman Catholic Chaminade High School, said Brother Joseph Charles Fox experi enced “irreversible” brain damage when he suffered “cardio respiratory arrest” on Oct. 2 while undergoing hernia surgery. Fox, who has since been in a coma at Nassau Hospital, “will re main in a permanent vegetative state,” said court papers filed Tues day in state Supreme Court. Eichner said three physicians at the hospital submitted affidavits at testing that Fox is “brain dead.” Fox “is religiously, ethically and morally deceased” and “his soul has fled his body and has been received in the hands of God,” the priest said. “It was, and is, the view of the Chaminade (Marianist) community. including Brother Joseph Charles Fox, that we are against the concept of trying to extend respiration through the use of extraordinary life support systems when the brain is incapable of any sapient or rational thought,” Eichner said. “If the good Lord decides in his infinite wisdom to allow Brother Fox to continue to respire, even though the extraordinary life sup port systems are removed, no one would dare argue,” he said. Fox retired in 1970 and took up residence at Chaminade. He has 10 nephews and nieces and Eichner’s attorney, William F. Levine, said all of them support the withdrawal of the respirator. The House voted Oct. 12 to remove the price control and allocation powers as it considered legislation to fund the Department of Energy and its related programs. But that amendment by Rep. James Courter, R-N.J., passed only 191-188 and Democratic leaders have been working to reverse the vote. They also noted the first vote came on a Friday afternoon, when 56 members were absent. United Press International South Carolina, the only state now accepting low-level nuclear waste, will bar any shipments of radioactive materials originally in tended for recently closed dumps in Nevada and Washington. In Nevada, Gov. Robert List said Tuesday he was going ahead with the shutdown of the state’s nuclear dump site — one of only three in the nation — despite mounting pleas from hospitals and research centers to keep it open. List also criticized President Car ter, saying he was more interested in politics than in developing a na tional policy for the disposal of the nuclear garbage. “Nevada is a gambling state but Tm not taking a gamble with our citizens, he said in explaining his decision to close the nuclear burial grounds in Beatty because of a safety violation. South Carolina, Washington and Nevada are the only states in the na tion that bury low-level nuclear de bris. South Carolina already accepts about 80 percent of the nation’s nu clear waste materials. Nevada’s trouble-plagued dump in the desert near Beatty was or dered closed late Monday by List after four radioactive barrels were found buried outside the fenced property. Washington Gov.
