The lawsuit filed to place the foundation in receivership also al leges less than $8,000 remains of $200,000 in scholarship money the DISD entrusted to the foundation. According to the suit, the five trustees want the foundation put in the hands of a court-appointed re ceivership “because of their inabil ity to determine the complete facts concerning the financial status of the foundation, and because they are unable to control the activities of the foundation president, Mr. (James) Bond.” The trustees have already ob tained a restraining order barring Bond from managing the founda tion, tampering with its assets or de stroying its records. TEXAS AVE The foundation was formed under the administration of former Superintendent Nolan Estes to so licit private donations for the district and market educational products developed by the district’s staff. Altogether, nearly $1 million in DISD money may have been lost in the district’s involvement with the foundation. Evidence introduced this past week revealed that among the foun dations losses was $47,953 donated by the federal government to fi nance a program to recruit and train reading tutors. The foundation was supposed to pay the salaries of two employees to run the program. The foundation owes the district $12,000 in bursement for salaries paid to! employees, according to DISD cials. The district has also ordt $11,000 in supplies forthereii tutor program. If there is no fed) money from the foundation to the tab, DISD may have topj] school officials said. Judge denies claim; obscenity law upheli United Press International HOUSTON — A federal judge Monday denied a constitutional challenge to Texas’ new obscenity law and refused to continue a 10-day order prohibiting police, sheriffs and district attorneys from enforcing it statewide. A lawyer for an adult materials dealer said he was shocked by the decision and would appeal. The new law broadens the defini tion of obscene materials and provides tougher penalties for many violations. U.S. District Judge Norman W. Black cited a recent ruling by the 5th U.S. Circuit Court of Appeals in New Orleans and said any law is un constitutional if people must guess at its meaning and differ as to its application and if people of common intelligence can’t be expected to understand it.
