[PG|-ss 1978 WARNER BROS INC From Warner Bros A Warner Communications Company Q United Press International AUSTIN — A Dallas legislator Tuesday appealed a parliamentary ruling of Speaker Bill Clayton in the strongest challenge of a presiding speaker s authority in the Texas House in 17 years. Rep. John Bryant, D-Dallas, ap pealed Clayton’s ruling that lan guage inserted into a conference committee report on a proposed constitutional amendment was within House rules. “But at some point it needs to be emphasized that the rules of the House were written to be followed, not written to be abrogated simply because we ran out of time. “Very clearly the riding of the chair is in error,” Bryant said. “However, rather than waste the House’s time with a vote, I with draw my appeal. The appeal meant Clayton had to ask another member to preside and allow House members to debate whether his ruling in the issue should be upheld. “I recognize the futility of appeal ing the ruling of the chair on the last night of a session,” Bryant said. His withdrawal avoided a roll call vote on the issue of sustaining Clayton’s ruling, but the action brought into the open a growing rift between some House members and Clayton. A group known as the Dirty 30 attempted in 1973 to appeal a ruling of then Speaker Gus Mutcher, but failed to get the second for such a motion. The last time an appeal of a ruling of a speaker went as far as Bryant’s action Tuesday was in 1961 when Rep. Jimmy Turman was speaker. Rep. Jim Nugent, D-Kerrville, arguing in support of Clayton, chided Bryant for the appeal. “You’ve just seen a soretailed loser standing up here at the mi crophone,” Nugent told House members. “I think what we see here is not an attempt to waste the time of the House. ” Bryant is among a group of about 50 House members who have met frequently during the special ses sion to complain about Clayton’s leadership and propose rules changes that would dilute the power of the speaker and give individual members more authority in opera tion of the House.
