The “Dawson Five” are five young black men charged with the murder of a white man in a grocery store holdup. William M. Also in the car was one of the defen dants, James Jackson Jr., 17, when the alleged incident took place. Rucker said Hammack pulled his pistol, “put it between his (Jackson’s) eyes, cocked the hammer and said, ‘okay, nigger, what did you all do with the gun?’” The former policeman, who served on the city force from November, 1974, to December, 1976, was the first witness called in efforts by defense attorneys to show that coercion was used against the five youths during the investigation into the Jan. 22, 1976, slaying of Gordon “Bubba” Howell, 61. As the defense also sought to show that an atmosphere of racial prejudice and fear permeates this south Georgia area, Rucker told of another incident involving Dawson Mayor Jimmy Raines. He said Raines “stormed” into the police station, demanded the department’s submachine gun and declared he “was going to shoot him some nig gers” who were reportedly hunting on Raines’ farm land. Under cross examination Rucker acknowledged he was under indict ment by a county grand jury here on two misdemeanor counts for al legedly stealing $25 paid into the police department in a burglary case. But he said he had never been fired from any job, including one with the Winchester, Va., police department before he came to Daw- As the hearing of numerous motions by the defense began Monday, the prosecution startled the courtroom by announcing it would not seek the death penalty in the widely publicized case.
