Kelley said Wednesday that the agency has good reason for filing unsubstan tiated allegations about the personal lives of congressmen and other citi- ns. Kelley said such a raw material can often prove helpful if a back ground check or other legitimate investigation of the individual be comes necessary. “Many times you don’t know when you get it whether you will need it,” Kelley declared in an in terview. He said he was certain that the FBI has not misused the data since he became director 18 months ago. Expanding upon his official ack nowledgement Tuesday that FBI files do contain unproven accusa tions about members of Congress, Kelley confirmed in the interview that some of the information relates to their personal lives. At the White House, meanwhile, Press Secretary Ron Nessen said President Ford does not believe that the FBI had done any direct snooping upon congressmen or senators. “The President does not approve of spying on Congress,” Nessen said. “Nor does the FBI ap prove of spying cm Congress.” Kelley said that the data on con gressional figures comes either through legitimate investigations or unsolicited tips from members of the public. The director said he had not per sonally examined the files to deter mine how many members of Con gress are included or what type of information is recorded. But when asked if there were de rogatory materials regarding per sonal habits, he replied, “I have been told there is and therefore I say there must be.” WASHINGTON (AP) — House Democrats deposed populist, an- tibanking Texan Wright Patman as chairman of the Banking Commit tee, on Wednesday, concluding a revolutionary series of leadership battles in which four chairmanships changed hands. Patman, 81, was defeated by Rep. Henry S. Reuss of Wisconsin. The dean of the House attributed his de feat in part to big banks, with whom Patman often squabbled. The vote Charge dropped against Mitchell SAN ANTONIO (AP) — Chief U.S. District Court Judge Adrian Spears dismissed Wednesday a charge against actor-singer Chad Mitchell that he conspired to import 400 pounds of marijuana. The entertainer had been found guilty in anon-jury trial last week on conspiracy and possession with in tent to distribute the marijuana. Although the conspiracy charge was dropped, Mitchell is still con victed of the possession charge. Sentencing has been set for Feb. 12. U.S. Attorney’s office representa tives asked that the conspiracy charge be dropped. was 152-117 for Reuss. The Democrats also voted 161-111 to retain Rep. Wayne Hays of Ohio as chairman of the House Administration Committee. Hays was opposed by Rep. Frank Thomp son of New Jersey, who accused Hays of abusing his power. Reuss said he had not solicited nor received any support from banks or other segments of the fi nancial industry in his bid to chair the committee which will oversee most of major economic relief legis lation. He said his immediate priorities will be passage of bills to lower in terest rates, allocate credit to pro ductive rather than frivolous pur poses and put controls on prices in the dozen or so industries deemed by the Justice Department to be non-competitive. In addition to Patman, Agricul ture Chairman W. R. Poage of Texas and Armed Services Chairman Ed ward F. Hebert of Louisiana were toppled by the Democratic caucus in a sharp blow at the seniority sys tem. Rep. Wilbur Mills of Arkansas announced earlier he would not seek re-election as chairman of the Ways and Means Committee. The caucus approved Reps. I’m willing to do what’s good for the country — that may sound trite but that’s ex actly the way I feel about it. ” He conceded that the FBI, like many other government and private agencies, faces a ticklish problem in drawing the line between what it needs to keep and what it should discard. Senator requests sellers to warn of zone dangers Rep. Ruess replaces Patman as chairman AUSTIN (AP) — Sellers of coastal land should be required to tell buyers of natural hazards, especially potential damage from hurricane flooding, Sen. A. R. Schwartz said Wednesday. The Galveston Democrat intro duced several bills dealing with coastal zone dangers, planning and management. “Along the unprotected barrier islands there are only two kinds of development: questionable and ab surd,” Schwartz said. “Unfortunately, thousands of families are moving into hurricane prone areas, and have no idea how destructive and deadly a hurricane can be. “I stayed on Galveston Island during Hurricane Carla in 1961, and I will never do that again. Action is needed to adequately inform coastal residents of the hazards and what actions to take to reduce such threats,” he said. Surge tides by Carla and Beulah (1968) inundated 3,164 square miles, an area more than twice the size of Bexar County, he said. And Beulah cut 49 washover channels through Padre Island, temporarily creating 50 islands from one island, he said.
