Rep. Jerome Waldie, D-Calif., said after a caucus Tuesday night the simple statement should win Republican votes — and possibly lend weight to a noncompliance impeachment charge in the fu ture. Other Democrats said that was the clear consensus at the caucus on strategy for tonight’s meeting —the inquiry’s first night session —although no caucus vote was taken. “We’re going to discuss com pliance or noncompliance,” said Rep. William L. Hungate, D- Mo., indicated that the aim is to win a stand against the Presi dent’s decision not to turn over tapes themselves without split ting the committee down party lines. Such a split could come, for instance, if a move were made to vote on enforcing the subpoena, such as through a contempt cita tion. Rep. Robert McClory of Il linois, a senior committee Repub lican who happened by the Dem ocrats’ caucus, agreed: “We don’t want to take any votes that will divide us.” But House Republican Leader John J. Rhodes said a similar caucus with committee Republi cans produced overwhelming agreement that “the President was substantially in compliance.” “The President is in compliance now and the committee should get to woxk with the material it has,” Rhodes added later. At least three committee Re publicans disagreed. Rep. Tom Railsback, R-Ill., said the President’s offer to let only the inquiry’s two senior members listen to tapes to verify the trans cripts should get a counterpropo sal from the committee that its chief staff aides also review the tapes. Republican Reps. William S. Cohen of Maine and Hamilton Fish Jr. of New York also said they considered Nixon’s offer in adequate. But senior Republican Rep.
