A poll released by the Texas Chapter of Common Cause showed that of 370 “usable answers” in a statewide telephone survey, 46 per cent said they had been fol lowing news of the convention in the newspapers or on radio-TV. Another 20 per cent said they had kept up with the convention some but “not much.” Several delegates said they doubt the interest was that high. As the convention entered its third week, the president, House Speaker Price Daniel Jr., said the full convention may consider the Bill of Rights next week—making it the first proposal to be debated by all the delegates. In testimony before the execu tive committee, State Agriculture Commissioner John White sup ported public election of agency heads such as himself. The ultimate outcome of an appointive system, White said, is “machine politics — a process which has been dying out in this country for half a century. AMPI, the nation’s largest milk cooperative, denies it violated the Fair Labor Standards Act, as the Labor Department alleged in a federal suit filed here last month. In a motion filed Jan. 9, AMPI asks for specific information of employes’ names and, in some cases, job classifications which the Labor Department did not mention in making its allegations. In listing its defenses to the suit Jan. 9, in another court document the 40,000-member, San Antonio-based cooperative denies it failed to pay overtime compensation to employes working more than a 40-hour week at plants in Rusk and Sulphur Springs, Tex., and Laurel, Neb. AMPI also denies it discriminated on the basis of sex at Rusk and its butterfat testing laboratory at Arlington, Tex. It denies repeatedly violating the Fair Labor Standards Act since Dec. 1, 1971, as the Labor Department suit charges. In its motion for more information, AMPI says the Fair Labor Standards Act does not require all employes to receive overtime and provides exceptions and exemptions in its regulations with respect to discrimination in wages on the basis of sex. The milk cooperative is also being attacked by the Justice Department, which alleged in a suit filed Feb. 1, 1972, that AMPI used illegal strongarm measures to gain control of milk production in 14 Midwestern states. The antitrust suit, which is still pending, has moved into political areas concerning the milk industry’s relationship to President Nixon and campaign contributions.
