Supreme Court Grants Stay On Part Of Civil Rights Act By The Associated Press WASHINGTON — The Su preme Court granted a stay Wed nesday, holding up a lower court decision which struck down a section of the Civil Rights Act as applied to a Birmingham restaurant. At the same time, Justice Hu go L. Black said he had been authorized by the five other justices here to say the court is willing to hear arguments on the case on Monday, Oct. 5. That is the opening day of the court’s new term, at which it has already agreed to hear the first challenge to the new law- the Atlantic motel case. It is rare for the tribunal to hear arguments on opening day. Black, who supervises the cir cuit where the cases were heard, said, “It is an established rule of law that courts of equity will not exercise their power to en join the enforcement of an act of Congress except under the most imperative or exigent circum stances.” On Aug. 10, Black had refused on the same ground to block enforcement of the civil rights law in the Atlanta case, in which a three-judge federal tribunal held the public accommodations section of the act constitutional. The Atlanta case involves a motel owned by Moreton Rolles- ton and a restaurant owned by Lester Maddox. The Birmingham case, in which the result was the opposite, in volves Ollie’s Barbecue. The situations are different. The Atlanta restaurant is locat ed adjacent to an interstate high way, close to interstate commerce, while the Birmingham establish ment is several blocks from the nearest type of interstate travel. Friday Deadline For 2 Senate Seats Filing closes Friday noon for two positions in the Student Senate, announced Don Warren, vice chairman of election com mission. Senior representative of the College of Engineering and re cording secretary of the senate are open. SAFEWAY Gunned Down In Viet Nam By The Associated Press SAIGON, South Viet Nam — Viet Cong guerrillas shot down two U. S. Air Force fighter-bombers in a ‘fight 125 miles southwest of Saigon Wednesday and presum ably captured two of their four crewmen - one American and one Vietnamese. The missing American was iden tified in Washington as Lt. George E. Flynn III of New Orleans, La., an instructor pilot. The planes were Douglas Sky- raiders, single-engine, propeller- driven two-seaters. They carried Vietnamese markings but are U. S. Air Force craft used to train Viet namese pilots. The Skyraiders were hit while striking Communist units that were atacking a town and two government posts in the Rach Gia area, on a bay of the Gulf of Siam. The occupants of Flynn’s plane bailed out. The Vietnamese pilot was rescued, but his tutor was missing and fellow officers be lieved him to be a prisoner. The second plane crash-landed. The U. S. pilot made his way to gov ernment lines. His Vietnamese companion failed to get through. Far to the east, other Skyraid ers helped blast suspected posi tions of the survivors of a Viet Cong battalion that staged a night attack on a clay-walled civil guard outpost at Long Phu. Though heavily outnumbered the 51-man garrison repulsed the at tack and even battled the Com munists for the Viet Cong dead and arms that fell outside the barbed wire defenses. Reputed to have killed 30 or 40 of the at tackers, they collected 20 bodies and 26 weapons. GM To Keep Same Prices By The Associated Press DETROIT — A General Motors announcement Wednesday that it would hold the line on its 1965 car prices allayed fears of an inflationary spiral in the auto in dustry. GM, largest of the auto mak ers, said basic prices of its new models which go on display Thurs day would Yemain unchanged for the seventh consecutive year. Ford had said earlier its Lincoln-Conti nental prices would be unchanged. Chrysler Corp. and the remaind er of Ford’s divisions are ex pected to announce prices Thurs day. American Motors said its new figures would be announced by next week.
