police chief can’t have that dis
cretion. He cannot pick and
choose who he wants to protest.
That’s unconstitutional.”
The five had not applied and
did not have a permit to protest,
said the Texas Civil Rights
Project, which Harrington
directs.
Crawford Police Chief
Donnie Tidmore said he had not
seen the lawsuit and could not
comment on it. He said the ordi
nance, in effect since 2001, has
worked well.
Tidmore said the advance
notice is required for scheduling
purposes and said some permit
requests have been denied
because they were not submitted
in a timely manner. He also said
some permits have been granted
for events scheduled the day of
the request.
“I will work with any group,”
Tidmore said. “1 am flexible.”

HOUSTON — Texas’
reliance on oil, coal and gas for
its energy needs is increasing
public health risks including
higher asthma rates, more heat-
related deaths and more expo
sure to mercury by women and
children, according to a new
report by a nonprofit public
health organization.
Officials with Washington,
D.C.-based Physicians for
Social Responsibility are urging
Texas residents, officials and
politicians to invest more in
renewable energy sources such
as wind, solar and biomass.
Robert Musil, executive
director of the nonprofit group,
said Texas’ problem is that it
relies on nearly 90 percent of its
total energy needs on fossil fuels
such as coal, oil and gas.
“Texas is in an old-fashioned
energy mold,” Musil said at a
news conference Tuesday.
“Dirty power in Texas has led to
death and disease.”
The group’s report, “Degrees
of Danger: How Smarter Energy
Choices Can Protect the Health
of Texans,” says that since 1995,
Texas has emitted close to twice
as much carbon dioxide as any
other state and that if Texas
were an independent nation, it
would rank seventh in the world
in carbon dioxide production,
the same as the United
Kingdom, which has more than
three times the population.
The report, part of an ongo
ing effort by the group to rate
each state’s environmental
record, also says that this depen-
dance on fossil fuels has created
environmental conditions

dren, with asthma. In 1

nation in the number of cases of
pediatric asthma.
Ozone air pollution

related illness and deaths, the
report says. In three of the
seven years, Texas ranked

heavy metal.
The solution, the group
is to switch to cleaner forms of
energy such as wind, solar
biomass, which is ethanol or
methane gases produced
plant matter.
“Texas has the greatest
capacity for renewable energy.
Given the extremes of climate
that already exist here in Texas,
you have plenty of wind, you
have plenty of sun,” Musil said.
The renewable energy poten
tial in Texas is estimated to he
about 400 times the state’s pre
sent energy consumption and
investment in this could create
71,500 new jobs in Texas by
2010 and 123,400 jobs by 2040.
